Question about pinned AR Magazine capacity

I am pinning the AR magazine, in order to keep the standard features. One of the groups on FB stated that there is nothing mentioned in the safe act about a fixed magazine capacity. Apparently in the state of CT it states clearly only 10 rounds. That got me thinking, my Marlin 60 I bought at Dicks (3 years ago before they were anti 2ndA) holds 14 or 15 if I am correct. So this guy was telling me he is building his pinned and we can have more than 10 rounds if it is pinned. My FFL suggested I stay with the 10 round magazine. So how it is legal to own my Marlin 60 that holds more than 10 rounds but my legal AR will not be? I am staying with the 10 round magazines and pinning them, as I do not want any trouble from a LEO in a bad mood. I am curious what other people think about this.

10 rounds is maximum for any magazine in ny and it is specifically stated as such. Tubular fed .22s are specifically exempted

Your friend and Facebook group and FFL are all wrong in saying that NYers can have mags with a capacity of more than 10 bullets , be it rifle, pistol, shotgun or linked ammo M-60 style.
The exception being tube fed rifles as there is no good way to limit capacity while still having it functional. I have not been able to read anywhere if loading more than 10 in the tube mag was OK or not.

To avoid confusion and possible legal issues I would get a 10 round magazine . PMags have removable floor plates which can help in case there us a feed issue.
Do your research on how to make the magazine non removable as there are no truly approved devices and send any magazines that can hold over 10.out of state.

Only tube fed 22lr. And you can load as many as you want if it is. Any other tube fed would have to be converted to hold 10 or less or sold out of state.

This is what you should be looking at. Take advice verbally or on a forum at your own risk. If your ffl really "suggested" a ten round magazine and doesn't know more than 10 rounds is a no go by now, I'd find a new ffl.

I say a 10 round mag is a 10 round mag.
Just buy magazines that are clearly marked ".458 SOCOM" and have the .458 follower in them. It works in Canada.

That probably works right up until they catch you with 11 rounds of .223 in the magazine.

If you do try to go the .458 route, I'd strongly suggest you have a .458 upper somewhere too, your lawyer will thank you.

Point 1- don't ever put .223 in it. I believe that while the standard .223/5.56 follower works with .458 SOCOM there is yet a .458 specific follower that works just that little bit better. Certainly supports the position of the magazine as being expressly for holding just the 10 rounds of .458.

Point 2- yes, agreed. I understand that Tromix is pretty much the last word in .458 uppers.

I myself have a hankering for a .458 SOCOM though I have no practical use for one and as I am not into reloading the ammo cost would be very high.

I have the 10 round magazines, and the guy on FB was just someone in a group. I was certain he was incorrect, however I wanted to get more opinions from others. I am going to use the mean arms lock for the magazines and get the side loader. I really just shoot at an indoor range for fun and practice and not planning to use a larger magazine, as I have never heard of using more than 10 being pinned plus if it were true everyone would have them. This site seems like a good source of information. I do not even have possession of the rifle yet, its not going to leave that FFL unless its legal.

Want to do a pistol build in 5.56/458 with the 5.56 for docking around at the range and the .458 for deer season

Dicks had great prices on black Friday, enough to get me in there. I had to mention how I do NOT like them, before some douche bag said not to shop there. Boycotting large companies does nothing. But they do not even sell guns any more so its a mute point. I miss the Walmart in white plains selling CCI mini mags and they had great prices on ammo.

My FFL sold me my AR with a 30 round Hex Mag with a 10 round limiter installed. I personally didn't feel comfortable with a 30 round magazine from what I have read regarding the NY Safe Act magazine limitations. I am concerned that NY State would say that my magazine is not premanently modified if it can be converted back to 30 rounds just by removing the bottom plate and removing the 10 round limiter. So I changed out the 30 round magazine for a 10 round Magpul magazine and bought a 5 round limiter for it, so I can use the rifle for hunting. When I am at the range I take the 5 round limiter out and I have a 10 round magazine. When I take the rifle hunting I put the 5 round limiter back in. Also, the magazine release has been changed out for a non functioning release. Here are two pictures. One with the original 30 round magazine and then with the new 10 round magazine.

Does nothing? Dicks has been in the news the last year or so for consistent drops in revenue and the stock market, they are literally falling apart (I believe also shut down a few stores) but no you are right boycotting doest do anything

And if THEY were selling it, it must have been legal. I meant generally speaking. I laugh at people that "boycott" however in this case I am happy it worked out and they are losing money. Do you want me to start another post about Dicks and boycotting? This was about fixed round magazines if you look closely at the title. And I have my answer, so really there is no need to keep replying off topic, right?

I think there is some confusion...
When you say .. "I am pinning the AR magazine, in order to keep the standard features."
Are you referring to pinning the magazine to the receiver? Or are you referring to pinning the magazine to only hold 10rds?

If you use a mag lock (pin, or similar) to prevent the magazine from being removed from the firearm. then yes, you can keep the features on your AR. But the rules is still only 10rds capacity. 10 round capacity in a "MAGAZINE" is NYS rule.

If you're talking about just pinning a AR "magazine" to only hold 10rds. That will not help you keep the "evil" features because it's a "detachable magazine".

The Marlin 60 is a "tube feed" rifle. Not "magazine" feed. tube feed is exempted.

I used the wrong terminology. I am attaching my 10 round magazine to the lower permanently. Typically I see this called a "pinned magazine" in the groups that are not NY specific. And the issue has been cleared up. Now I know the tube fed 22lr is different and has different laws. I am pinning my magazine to the lower. At least I did not call it a clip

Just taking out the riser isn’t sufficient to get a functional 30 round mag. You will get 30 in but not 30 out. You also have to replace the spring. So having standard springs does make them a nice route to having mags that you can convert when going to free states or if the law is overturned and you don’t get stuck with your dick out scrambling for mags in a rush before some arbitrary deadline like they did in California.

With the riser in these are 10 round mags! Law doesn’t say anything about permanence. You might not want to buy them in the same order as the springs or take them afield together, but the springs are just springs and the mags are just 10 round mags.
