An unconstitutional law is unconstitutional regardless of the application, be it as an adjunct to another criminal offense (aka piling on charges), or as a stand-alone. The subject of the action does not grant an unconstitutional statute legitimacy. In the world and state we live in, however, the inverse seems to be the common practice.
