So, my understanding here is that the Terror Intelligence Improvement Act from 2020 is being reintroduced this legislative session.
The crux of the bill is really:
(1) IN GENERAL.—Not later than 90 days after the date of enactment of this Act, the Attorney General shall establish a process under which, for any person who is, or within the previous 10 years was, the subject of a terrorism investigation by any Federal department or agency, the Attorney General may—
(A) delay the transfer of a firearm or explosive to the person for a period not to exceed 10 business days; and
(B) file an emergency petition in a court of competent jurisdiction to prevent the transfer of the firearm or explosive.
So it gives the AG authority to just deny someone their rights without due process, whether for the automatic 10 days, or permanently, as they see fit. I assume the cost of fighting (B) is going to be extremely high, and essentially a case of a right delayed is a right denied legislation. I cannot foresee a court in NY that will be fair or impartial towards denying option (B) on constitutional grounds.
