Rules On 80% Lowers

Good afternoon gents, I have a few stripped lowers standing by and a few coming in that I’ll finish building. I wanted to know what are the rules on 80% and is it legal to have a buddy or a FFL dealer do finish the rest of the process of making it a stripped lower.

IIRC, your buddy cannot finish it for you and if the dealer is a manufacturer, they can and then they with fill out the 4473 and you go through the background check to purchase it from him. Sort of defeats the purpose.

Every time I tried to buy one they wont ship to NY . Id even drive to PA but I dont know if I need proof of residency .

80% finished by you good to go (for now). 80% done for you by someone else, Not legal, unless your buddy is a FFL with a manufacturer's license. the whole a 80% thing is legal if you are the one who makes it into a "firearm receiver" as defined by the ATF. If someone (except licensed manufacturer) makes it for you then they are manufacturing a firearm without a license. You can make as many 80% receivers into real live guns as you want as long as you are not making them with the intent to sell and they are for your own personal use. If you one day decide to sell one the ATF recommends you mark it according to their guidelines. I also don't recommend you make a habit of selling home made guns, you will be inviting the ATF into your life.

Yeah I totally understand I just wanted to purchase a few but don’t have the machinery to make it a stripped lower. No intent to sell just have as much as possible.

If you are going for volume buy complete lowers, they are cheaper and require little skill to put together. If you like a challenge and don’t mind spending money on tools go the 80% route. I have well over 5k in tools to make guns, it doesn’t make sense for me to buy factory 1911s, Sig 320s, Glocks, AR15s, or AR10s anymore.

the last on heard on 80's builds .. is ..

you have a 80 and i have the tools .. router , milling machine .. ect .. i can't do it for you .. i would have to teach you how to use the tools and your on your own .. no more 80's building parties with a friend with the tools to do it for you ..

If I take an 80% that's just a chunk of aluminum and I just drill the one hole for the the trigger, now it's a firearm (ATF version, not NYS).

So, can someone else then work on my (now) firearm ?

Say mill out the pocket for the FCG and drill the other hole ? They're not manufacturing one, I did that when I drilled the hole.

I understand that to do that as a business they would still need a gunsmith license, but not a manufacturing license ?

Would they be able to work on my unserialized firearm just like they could my old 1920's era unserialized rifle ?

My take on this is do what you need to do and keep your mouth shut about it.

"I want to get an 80% so there's no serial number and "they" won't know about it."

Also, "Hey everyone! Look at this sweet rifle I built from an 80%"

Exactly, all gray area. No one really knows for sure.

No one would ever know if I came to your house and you used your drill press to put holes into my 80 percent and gave you 20 bucks for it. It’s an unenforceable law unless you had a website offering services and prices to finish 80 percent lowers.

There was a story a few years back, big thing in California was to have "80% parties" bunch of people got together at someone's place who had a cnc or drill press, paid that person to do all the lowers

State got wind of it and started cracking down
