Kavanagh should pretty much slide right in and I hear he's not a big fan of the labeling of "assault rifles". I had read some of his opinions. Essentially, he says pretty much that a semi-auto pistol is basically same as a semi-auto rifle and the term "assault rifle" is a demonizing and politically charged term used to opposed the 2A.

What are the chances of some kind of SAFE ACT amendment banning the restrictions posed on us by Cuomo with a SCOTUS ruling?

Why wouldn't he be for labeling something correctly, if it's an assault rifle then call it an assault rifle


Weird cause there have been so many different assault rifles designed and built here in the U.S. and all over the world for the past 75/76 years atleast, how is the actually opposing the 2a?

Why open the door to have all semi auto centerfire rifles deemed "assault rifles" ?

Well seeing as the media and the anti 2A camp have been using the made up term "assault weapon". While the term "assault rifle" is an actual thing first showing up (successfully) during WW2, this one little country, you may have heard of them, called Germany made a new concept and named it the sturmgewehr. Yeah so since then there have been assault rifles they are a real thing with a real definition

But you know potato potato, tomato tomato, magazine clip.

For a rifle to be considered an actual for real assault rifle, It must have a selector switch that allows automatic fire
or 3 round burst or semi-automatic. Civilian versions are semi-automatic only. Therefore they ARE NOT assault rifles.
For an example, An AR-15 without the select fire capability is nothing more than a semi auto rifle... FACEPALM

The politicians and media use the term incorrectly to scare the sheep.

This thread is going sideways already. Maybe we should actually try to answer the OP's question.

And no they keep using the term assault weapon because unlike most of yall boomers, they have actually done some, some, research and corrected their terminology to now not call things assault rifles because they know they then lost the argument, so they are reverting back to the term assault weapons. But all the fudds and boomers keep using assault rifle

Someone would have to file another challenge to the SafeAct and go through the lower courts on up to the Supreme Court. I'm not sure that NYSRPA could just pick up the suit they dropped and apply for cert to the Supreme Court. Idk. I know there are other challenges from other states, but even if they took one of those and declared AWB/feature bans umconstitutional, I fear that unless it is the SafeAct itself being struck down, NYS will just ignore the ruling like they have with Heller Etc.

The SCOTUS is nothing, an example made by States like CA & MASS that just ignore their rulings and guidance! The SCOTUS does not have any teeth and Barack Hussein Obama the Harvard Constitutional Lawyer exposed that very thing...

Don't look to SCOTUS to save you, or your precious little, so called Rights! They won't, and nobody will. Only "YOU" can do that by invoking them every single day. That's actually the one thing they've said recently that rings true! That in order to enjoy your Rights, you "must" invoke them, there is no assumption that you want them. And many freely give them away.

Gun control advocates are hyperventilating over Kavanaugh's Supreme Court nomination

I don't know if NYers will ever get our gun rights back. But with this 2nd Trump high court pick maybe the rest of the US free states will be safe from the gun-grabbers.

Self correction - America will never be safe from the gun-grabbers. Cause they breed like Roaches.

Kavanagh will be good fro the 2nd Amendment. He may or may not be good for NY. Like others above have said, even if a Pro-2A ruling comes down from SCOTUS, the pukes in Albany will figure out a way to weasel their way out of it or around it. unSAFE is a perfect example of this as, as far as I'm concerned, it goes against the Heller decision. Personally, unless unSAFE is specifically challenged and brought before SCOTUS I don't see NYS doing jack squat about it. And for the record, I don't see the NRA, NYSRPA, SCOPE or any other pro-2A organization jumping at the bit to file a lawsuit against unSAFE.

To answer the question as to why hasn't SCOTUS picked any 2nd Amendment cases since Heller and MacDonald: It's a bit cryptic, but my guess is that it had to do with the make-up of the court. Scalia was solidly pro-2A but he was also savvy. He knew that court was pretty much evenly split liberal/conservative and the liberal side of the bench would never be pro-2A. For the longest time Anthony Kennedy (who was always luke-warm on gun rights) was a "swing vote" for the court. Rumor has it that Kennedy made a deal with Scalia to vote in favor of Heller and MacDonald with the stipulation that there be language in it allow states to permit some form of regulation and to state that the 2nd Amendment is not entirely absolute (personally I think all natural rights are absolute but that's an argument for another day). Scalia knew this and as a result didn't push for any other 2nd Amendment cases until a more conservative court could be appointed. Sadly he died before he could push for more 2A cases but with Gorsuch and (hopefully) Kavanagh on the bench we'll start to see some more action since there is less worry of a "swing vote" the way Kennedy was. Then again Roberts could shit the bed like he did with Obamacare so who knows.

I just hope if and when Kavanagh gets in, there will be a wave of challenges (law suits) to these "Assault Weapon" bans.
How can you ban a firearm based on ergonomic features (pistol grip, adjustable stock, or muzzle brake/compensators ??
And what's this notion of limiting one's ability of self-defense by limiting their mag cap to 10 rounds.
