I have to think it will be a 5-4 decision in our favor, simply because a gun can be made out of common parts found in every hardware store. They can't consider pipe fittings not to be "guns" and at the same time call a solid hunk of aluminum that is externally shaped but requires precise and somewhat extensive machining inside to be a gun.

Kinda. GCA'68 mandated that there be a serial number. Many manufacturers had been serializing for decades before it was mandated.

Yes, you’re correct. My with restrictions like you can’t sell them was more in reference to the history, text, and tradition. Way back when there were no background checks and you went to your local gunsmith who wasn’t regulated and bought whatever you wanted. You and a buddy could make them and hand them out. I think we will be billowed to make our own for personal use but not sell them or pass them out on the corner like it was 1775.

That's how it works now. In 1960 they didn't have a prayer.

They had to pick up the gun at the crime scene and start interviewing people who knew the perp.

It doesn't matter how the criminal got the gun. The victim has been harmed regardless if the gun was serialized or not.

Criminals steal guns. They make guns. They even buy guns legally before they get caught.

This whole "ghost gun" debate only serves to take the attention from the criminal to the object.

My guess is any manufacturer will have to serialize everything, comply with ITAR, and file/pay FAET if a "ghost gun" is ever transferred to a new owner.

The justices agreed to weigh in on a challenge to a rule by the Bureau of Alcohol, Tobacco, Firearms, and Explosives regulating so-

"The dispute over the “ghost guns” rule is one with which the justices were already familiar. Last June, a federal district judge in Fort Worth, Texas, barred the ATF from enforcing the rule anywhere in the United States. U.S. District Judge Reed O’Connor agreed with manufacturers and sellers of ghost gun kits and parts that applying the rule to ghost guns was inconsistent with federal firearms laws. When the U.S. Court of Appeals for the 5th Circuit, which hears appeals from federal trial courts in Texas, declined to put O’Connor’s ruling on hold, the Biden administration came to the Supreme Court, asking the justices to step in.

By a vote of 5-4, the justices in early August allowed the Biden administration to temporarily reinstate the rule while the challenge to it continued in the lower courts. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh all indicated that they would have denied the government’s request and allowed the rule to remain on hold.

The 5th Circuit heard oral argument in the case in early September and issued it in early November. It upheld O’Connor’s decision, concluding that the rule “flouts clear statutory text and exceeds the legislatively-imposed limits on agency authority in the name of public policy.”

My take is that the ATF and Xiden are going to lose this, and ghost guns will be back on the menu, as they do not meet the definition of "firearm" that the ATF has played fast and loose with. They won't be able to stop manufacturers from selling 80%, they won't be able to force anyone to put a serial number on their privately made weapons, and they won't be able to force anyone to go through a NICS check to buy parts to make their own Arms.

And if that happens, why in hell would anyone buy another weapon through the FedGov NICS registration system rather than just make their own? At least in terms of ARs and modern pistols?

Of course, if we could just get one competent gun rights group to directly attack the 1934 NFA, the GCA of 1968, and the Brady Bill of 1991 (rather than fucking around with all of these other cases that keep us begging for permission slips), the worst Infringements would be struck down under Heller and McDonald and we could move on to get rid of the rest of the schemes that have been set up against our God-given and Natural Rights.

As always, there is always the chance that the SUPREMES will betray us (cough Roberts cough) and let this bullshit stand, but I think by letting it play out in the lower courts where ATF lost over and over again, and letting the Xiden regime the chance to appeal to the SCOTUS, this baby is likely to be properly put to bed.

The definition of "firearm" is very precise and goes back many decades, and the ATF has been lying their ass off about that to keep this shitshow going. Not that I think ANY definition of Arms should have any merit when it comes to what we can Keep and Bear, but only to make the point that the ATF hung their shingle on that definition for well over half a century, and its obvious their recent deceptions surrounding the matter are flat out wrong and nothing more than a weak ploy that doesn't pass muster even prima facie.
