Benelli M4 w/ 7+1+1 is GTG. Had one before I had to sell it for financial reasons and LOVED it. Will get another one as soon as I'm back on my feet again.
Note you cannot have 7 round tube with a collapsible stock BUT you can have a collapsible stock (or any other "evil" feature other than 7 round tube) with the 5 round tube Benelli configures for civilians.
I don't think you can buy the Benelli factory 7 round tube as a civilian but you can get an aftermarket 7 round tube for it. This is the one I put on my M4 and it was awesome. Yes and no. You would be legal under the NY SAFE act, but would be out of compliance federally under 922R rules.
So if you replaced your tube magazine with an aftermarket magazine that holds 7 rounds, you would need to replace 2 other parts that were US made. For the Benelli M4, the cheapest and most readily available to replace parts would be the follower and the forearm/hand guards in addition to the magazine tube. Replace all 3 parts and now you are NY SAFE and Federal 922R compliant.

According to NY Safe Act: Semi-Auto shotgun is legal so long as it doesn't have one of the banned features (telescoping stock, thumbhole stock, 2nd hand grip for non-shooting hand, fixed magazine in excess of 7 rounds, detachable magazine).
So if I read the above correctly, a benelli m4 with a fixed stock and an aftermarket (or factory) 7 round magazine tube should be legal, correct? You can load 7 + 2(1 in chamber, 1 underneath bolt group) but technically you only have 7 in the magazine tube itself. Should be legal, correct?

It's spelled out in the definitions / exemptions pl265.22(g)(iii) ... you can have evil features (e.g. collapsible stock) on semi-auto shotgun with fixed mag capacity of 5 or less. 7 round tube is not defined as an evil feature so it is GTG provided there are no other evil features. So you can't have a collapsible stock and a seven round tube. But you can have a collapsible stock with a five round tube. BTW pistol grip is also GTG regardless of 5 or 7 round tube as it is not defined as an evil feature on a shottie. Hope this helps.

They probably meant a vertical grip, but that's not what they passed.
It is, but if some DA gets a bug up his ass for you, they can always apply it as written.I assume that's what the language meant as well.
