Resurrecting old thread here, but can someone confirm the above?
According to NY Safe Act: Semi-Auto shotgun is legal so long as it doesn't have one of the banned features (telescoping stock, thumbhole stock, 2nd hand grip for non-shooting hand, fixed magazine in excess of 7 rounds, detachable magazine).
So if I read the above correctly, a benelli m4 with a fixed stock and an aftermarket (or factory) 7 round magazine tube should be legal, correct? You can load 7 + 2(1 in chamber, 1 underneath bolt group) but technically you only have 7 in the magazine tube itself. Should be legal, correct?

Yes and no. You would be legal under the NY SAFE act, but would be out of compliance federally under 922R rules.
So if you replaced your tube magazine with an aftermarket magazine that holds 7 rounds, you would need to replace 2 other parts that were US made. For the Benelli M4, the cheapest and most readily available to replace parts would be the follower and the forearm/hand guards in addition to the magazine tube. Replace all 3 parts and now you are NY SAFE and Federal 922R compliant.

I'm not too worried about the 922R rules...I've literally never heard of someone being put in jail for putting a 7 round magazine tube on their benelli but then neglecting to replace 2 other parts with US-made components. I totally understand what you're describing, but I'm much more focused on what the NY Safe Act requires than I am worried about 922R compliance...i think the latter regulation is more pertinent for firearm retailers or manufacturers anyways.
I think Freedom Fighter Tactical makes big deal of the 922r compliance because it encourages benelli owners to buy more accessories from them...not that they're necessarily wrong by putting that info out there, but I just don't think the US Federal agencies are going to bother spot-checking lawfully-owned shotguns to see if the # of foreign-made parts are in 922r compliance....and I don't think most local LE are even tracking on 922r compliance to begin with.

It's spelled out in the definitions / exemptions pl265.22(g)(iii) ... you can have evil features (e.g. collapsible stock) on semi-auto shotgun with fixed mag capacity of 5 or less. 7 round tube is not defined as an evil feature so it is GTG provided there are no other evil features. So you can't have a collapsible stock and a seven round tube. But you can have a collapsible stock with a five round tube. BTW pistol grip is also GTG regardless of 5 or 7 round tube as it is not defined as an evil feature on a shottie. Hope this helps.
I'm not advocating flagrant disregard for federal law, but I am noting that there are millions of gun owners out there, many with foreign-produced firearms.
Do you honestly think the the ATF is willing, or even capable of going out and checking to see if each and every one of those firearms is 922r compliant? You wouldn't even be able to tell unless you started disassembling the firearm, and even then I doubt you could get definitive proof of non-compliance.
Safe Act, potential "assault" weapons regulations at the federal level (depending upon how the next election goes)...those are firearms issues on my radar. 922r compliance barely registers. The only reason Freedom Fighter Tactical has that stuff on their website is because they want to scare Benelli owners into buying more accessories from them. I have never heard or seen a private citizen get busted on 922r regulations (at least as it pertains to lawfully-owned firearms). My 2 cents.

I'm considering a Benelli M4 (5-shot with fixed stock). Once I get it, I'd like to ditch the factory 5-round tube for an aftermarket 7-rounder (likely Freedom Fighter Tactical) and an aftermarket stock with shorter LOP and cheek riser. Seems like that is perfectly legal with the SAFE Act.

They probably meant a vertical grip, but that's not what they passed.
