meanwhile, they are letting rapists and violent criminals roam free without bail even after being arrested, but when a soldier of the US Army (I have family that retired from 10th Mtn as well) is caught carrying a gun he is facing 15 years. WTF!!!

After or most likely during His stay with the public authorities he will be charged by Uncle Sam also. They say there is no "double jeopardy" in the military but at the least he'll be charged with awol if no bail...conduct unbecoming..etc

In fairness, thats the statement i based my opiniin off of. If the guy was protecting stores and the cops arrested him then screw them.
Stupid is as stupid does, as Forrest Gump would say. Being a Soldier is no excuse for breaking the law, they are all briefed when they get here about the gun laws in the PRNY. After 2019 anyone who gets orders assigning them to Drum even state do not bring pistols ( think they actually say any firearms, but have not verify that) with you.

While I completely disagree with how this was handled, the situation as I was told by someone there was there the group was in "military style gear" and OC pistols. I am sure they were targeted because they were "out looking for trouble".
While it seems its pick and choose on what laws are followed this week, he was carrying without a permit and non concealed, which is not legal in this state.

That is open to debate, but we won't go there. The fact that he was however, shows that he made no attempt to conceal it because he did not believe what he was doing was unlawful.
He got himself in a bad spot. That's why it's so important to know the laws of the state you're in. This even applies to us. If you're going to another state that honors the NY permit, you better make sure you know where guns are and are not allowed and their laws (ex: restaurants that serve alcohol, parks, businesses with signs that are enforceable, must notify police, etc.. etc..)
We take for granted that NY is actually quite generous with where they allow us to carry, with the proper permit. There are very few restrictions. Another big thing to be aware of is some states specify they only honor resident permits from certain states, so just because state A accepts the permit from state B, doesn't mean they accept your non-resident permit from state B. DO YOUR RESEARCH. Saying "I didn't know" in court isn't going to help you. The criminals say the same thing.

Yea you're totally right. We should go somewhere like TEXAS, or FLORIDA where the gun laws are better! We can carry with more freedom than we can here! Yea, that's it!
WRONG.
NY allows guns carried in way more places than most states. Even the most "gun friendly" states. You'll learn the day you're locked up because the restaurant you're eating in derives 51% of their business from alcohol sales and you failed to read up on their financial records before you went. Or when you're in church saying a prayer and your shirt comes up and exposes a grip.
In the back of the cruiser you'll be weeping saying "But, but, but, I don't know... It's not illegal in NY......"

I actually agree with Chevusa on this point. Obtaining a NY permit is a overly lengthy, invasive, draconian and expensive process but after you have it and are unrestricted its actually more useful than many free states. For now there is no renewal fee like most other states. There are no restrictions to carry in bars, resturants with bars, churches, casinos, hospitals, etc, etc. In Tx for example any business that does not you armed just has to put a notice on the door, and there are plenty displayed surprisingly.
Texas has specific penal code charges for carrying a gun in a business with a sign posted, reading "Pursuant to Section 30.06, Penal Code (trespass by license holder with a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a concealed handgun"
An offense under this section is a Class C misdemeanor, and may be upgraded to a Class A misdemeanor if you do not leave when personally asked.

I’m hoping he was an MP because if not this will be really unfortunate on his behalf. IMO there should be a federal law allowing all Military/Vets exempt from the gun laws and carry with their CAC card.

Well there is a military exception in the penal law for carrying a firearm, but he obviously didn't fit the criteria.
