A three-judge motions panel should act on this appeal very quickly. What happens will likely depend on who is assigned. I was tempted to read more into the interim stay than it really means, but it's really a matter of extending Sudabby's own 3-day stay a few days to give the panel time to be assembled, actually read and discuss the papers and make their decision than tipping the hand of a panel that hadn't yet been assigned. It's too bad they did this but not surprising. You could say the 2nd circuit didn't have to do an interim stay but neither did Sudabby have to stay it for 3 business days, so it's as much Sudabby's fault as the 2nd circuit that this hadn't gone into effect yet. But a short stay pending the filing of an appeal is normal in a major decision like this and is sort of a matter of courtesy between the different layers of judges. We can still hope that a non-wacky panel will at least allow the order to go into effect until the preliminary injunction that no doubt Sudabby will issue.

Another thing, the state's reply memorandum gives the word on what the State considers the scope of the TRO to be:
The state here is saying that even if a TRO were granted, the district court have only restrained the defendants from applying the law against the plaintiffs. But the state understands the TRO, as I did, to enjoin only the defendants, and not other local law enforcement in other counties or municipalities. So, if you want to argue with my understanding of the TRO, it was the same as the state's understanding of the TRO, which would presumably match that of any other local law enforcement, that with the state's backing, decided to go ahead and enforce the CCIA while this lawsuit is ongoing if the TRO or preliminary injunction went into effect.

When you start the think about it it would just be best if the nation Balkanizes and everyone goes their merry way. I don't think anything will come of this. On Oct 25 Suddaby is deciding on the preliminary injunction. The TRO expires by then. My guess is that the 3 judge panel will be dealing with the preliminary injunction. I was thinking today that we really haven't gotten to take a victory lap yet. I feel like we waited so long fro the Bruen decision, and before we could even enjoy it our dear leader pulled the carpet out from under us. Now back to the courts for a long time. I am really hoping that we can have a victory party when this is all over.

If the state would take the partial win and partial loss and live with it, I would consider it a victory. Problem is, there is no compromising with tyrants. If Suddaby threw everything out except one square inch of the state somewhere in the middle of the woods and said you CAN carry there and nowhere else, the state would fight over that one square inch.
