I’ll reserve judgment until I know everything including social security numbers, what the perps and cops ate the night before, lot number and manufacturing date of the bullets they found, what color the lock line on the ziplock bags are and until IAB reports back on their check of the cops’ black socks to include whether each pair worn was matched with the original packaged left and right pieces.

Well to be fair, there is no constitutional right to sell drugs or use counterfeit money. So I can’t argue that. But the gun charge...No.

Criminal use of a firearm is a constitutional law used in many states. That is the appropriate charge.

So often in these threads it seems like there is no tolerance for the existence of any penal law that involves the possession of firearms - even for criminal intent. The take away for me, rightly or wrongly, is that some supposedly "unlawful" things shouldn't be unlawful whilst other unlawful things obviously should be- in the eye of the beholder.

What amazes me is people who justify oath breaking on a crime that shouldn’t be a crime.

Criminal Possession of a Weapon shouldn’t exist no matter who the person is. Criminal use of a Weapon should. One is a constitutional law and the other isn’t.

Using a gun in a manner for which it was not intended in the commission of a crime should absolutely heighten the charges. That's exactly how you specifically target the actual offenders and leave law abiding gun owners alone.

Before politicians started demonizing guns and gun owners so blatantly, they'd charge someone with assault with a deadly weapon. If more people are killed with knives, hammers, clubs or even fists and feet, why should the rifle pictured above warrant a special charge? Its not the tool used to commit the crime, its the person performing the criminal act.
