Yes in deed. These honest guys we have in Albany designed this to give themselves an out. As shurmeroid would say We have to close the pension qualification loophole! I mean think about it. Silver and company taking bribes knowing that they will at least have a pension if caught. No deterrence there. Corruption is not the exception in Albany, it is the norm.
