Trump plans to sign executive order curbing birthright citizenship: report

About damn time. This has been used and abused by not just Mexican and Central American illegal immigrants but illegals from every country on the planet. Come here, squeeze out a kid, and not only is the kid a citizen (who really shouldn't be in my opinion) but the family gets Social Security benefits as long as the kid remains a minor.

Citizenship should be bestowed on an individual who has at least one parent who is a US Citizen or those who go legally through the naturalization process.

I agree but maybe this leads to a cert to overturn the original SCOTUS ruling on citizenship.

I watched an interesting video about how citizenship work before the SCOTUS ruling. I like the org way better.

This is the section in question
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside”.

If original intent is applied it is fare game since it was done to protect the children of the recently freed slaves who were “ under the jurisdiction”

The 14th Amendment citizenship clause was dealing with ordinary citizenship, either by birth or naturalization. Hence, an alien who is not legally inside the USA is not capable of bearing children who are citizens of the USA. A person has to be under the jurisdiction of the USA at the time children are born to that person for those children to be regarded as U.S. citizens by birth.

But is this the right way to go about it? Issue an executive order that may be unconstitutional so it can be challenged in court? I have no problem revisiting the 14th amendment but go about it the right way.

(7:40 - What does it mean to be "subject to the jurisdiction thereof?"

14th amendment states:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.​

The Left, as well as many casual readers of the Constitution, have forgotten the "and subject to the jurisdiction thereof" part. If citizenship was only a matter of geography, the section would have read: All persons born or naturalized in the United States are citizens of the United States and of the state wherein they reside.

I am not a fan of how far executive orders have gone but they have been in practice since day one and for the point of the administration of the executive branch they are nessassary. If someone or a group feels an order is outside of the presidents authority the can take it to court. Weather the order is unconstitutional or not is a matter of opinion until it’s settled

I do not like overreaching executive orders. But, from my standpoint of strict interpretation of the 14th amendment, this executive order would be simply asking the federal government to follow the constitution as written. Therefore, I'd consider welcoming a SCOTUS ruling. After all, if they maintain the status quo, nothing changes. But...if they rule as originalists, then the "anchor baby" concept disappears.

A few months ago, when discussing overall immigration policy, I wrote: “There is no greater disconnect from ordinary Americans -on any singular issue- than the policy positions of Democrats and Republicans in Washington DC surrounding immigration. President Donald Trump is confronting their unified interests.” The reaction from Speaker of the House Paul Ryan is directly related to this truism:

(Via Associated Press) […] The top Republican tells WVLK radio in Kentucky, “Well you obviously cannot do that. You cannot end birthright citizenship with an executive order.”

Ryan’s comments Tuesday offered a rare challenge to the president — from his own party. […] Ryan says Republicans didn’t like when then-President Barack Obama “tried changing immigration laws via executive action. He says “obviously as conservatives we believe in the Constitution.”


Ryan is retiring but the No. 3 House Republican, Louisiana’s Rep. Steve Scalise, said on Fox that he’s glad Trump is considering options. (read more)

It does not go unnoticed that Speaker Ryan never challenged DACA.

It does not go unnoticed that Paul Ryan fully supported the June 2014 house vote for the Senate Gang-of-Eight immigration bill; until Majority Leader Eric Cantor was primaried 48 hours before the vote.

The issue of lax immigration, and the subsequent lack of enforcement, is the cornerstone for the UniParty in Washington DC. It is one of the central elements that isolates the professional political class from the majority of common sense Americans.

For the Democrats, support for open-borders and lax immigration enforcement is part of their overall ideology and fabian world-view. For traditional republicans support for lax immigration, which allows exploitation of labor, is driven by the Wall Street views of the U.S. Chamber of Commerce (President Tom Donohue), and various elements associated with multinational corporate interests (Koch Brothers).

No amount of external political pressure upon DC will change this dynamic.

The only thing that will fracture this entrenched DC ideology is a long-process to dismantle the system that enables mutually beneficial arrangement.

Does anyone honestly believe the 14th Amendment had an intent of giving the spawn of an INVADING ARMY citizenship ?

Yet that is what ILLEGALS ARE. An invading army.
