Apparently it was an SKS:
"Possession of a loaded firearm" always irks me. SO WHAT if it's loaded? It's not illegal! It's just "scarier" and helps to sensationalize the article.
Both suspects were charged because they have prior convictions preventing them from legally possessing such a weapon.
That's beside the point. The point is, there was zero reason to mention that it was loaded.

Unless it had a removable mag, an SKS is not even classified as an "assault rifle" (I hate that term!!) in NYS. You can have all the same fun features as normal Americans, as long as it has the integral box magazine.
you get Possession of a loaded firearm , even if the gun and all mags are unloaded and ammo is with you .. don't matter where the ammo is in the car/truck/pocket/socks .. .. if you have both .. its loaded .. even thou its not .. Actually there is. Having the weapon without ammunition is a lesser charge.
Wait why do you hate that term?
And yes and SKS could be an assault rifle
The reason I hate the term "assault rifle", is the way it is misused!
Here is the actual definition of an assault rifle:
An assault rifle is a selective-fire rifle that uses an intermediate cartridge and a detachable magazine.
- Semi-auto rifles with fixed magazines like the SKS are not assault rifles; they do not have detachable box magazines and are not capable of automatic fire. (SOURCE: Assault rifle - Wikipedia )
AND, it is not even an assault rifle per the NYS SAFEact if it does not have a removable magazine!
SOOO I stand by my original statement!

Ah Ha! Don't be ridiculous! This DOES have the ability to accept a removable magazine! All that is needed is a few minutes! That is it! (Besides a hack saw, grinder, welder, drill press, a CNC mill, and machine shop) The law has it in plain english! The 'ability to accept'. That rifle most definitely has the ability to accept! Clear as day! No lawyer, judge, or jury could deny that! Just ask @Willjr75 he can confirm this undeniable truth!...AND, it is not even an assault rifle per the NYS SAFEact if it does not have a removable magazine!
Why was a warrant issued to search the home? What else were they doing that raised suspicion. Did someone eat them out? Besides them being felons.
Nothing like sensationalism in the news reporting.

Either way, they were in violation of possession of ANY firearm by a convicted felon (assuming this is the reason they can't be in possession!). BUT, we all know that doesn't play into the gun-grabbers agenda!!
That is too personal to be reported in the news.
LmaoThat is too personal to be reported in the news.
Yup, guilty until proven innocent.
Er, something like that.
I appreciate your honesty. One of the reasons why I would be a horrible member of a jury.
Correct. It's what the actual law says even if it wasn't intended that way. They forgot to define a fixed magazine just like they forgot to exempt cops when they wrote the safe act or exempt the ability to open carry while hunting or carrying as an armed guard.Ah Ha!
