I think this is a pointless argument. Any NY county will do what any NY county will do regardless of what the law says as evidenced by restrictions and corrupt courts who have ruled in favor of judges putting those restrictions in contrast to what the Penal law says.

Some counties have even asked for Facebook passwords.

Why is this even being argued? The whole permitting process is unconstitutional.

What is your recourse ? To simply accept their denial when you apply for the permit ?

My first time applying I was denied, I just got back from the military after 5 years, never changed my residency, I was going to school full time and not working.

I was denied and their reasoning "I should wait until I have finished school and established myself in the community" same day I got the denial letter I contacted a lawyer went down to the pp office asked when I would be able to reapply, was told "I can't tell you when but I can tell you I will just deny you again" I said that's fine I'm on my way to meet with a lawyer with my denial letter can I have another application. That one was approved

If that kind of thing shows up on a regular background check, and doesn't require you to sign away your health privacy HIPPA rights...then I am reversing my opinion.

It was my understanding that your private medical records were the only way to prove it one way or the other...

If not, that would mean they are demanding something that has NOTHING to do with the PL400 requirements.

As far as I know, if you go voluntarily it's part of your private health records and would require a HIPPA waiver. It shouldn't be grounds for denial though as the law states "involuntary" as the qualifier.
If a judge has you involuntarily committed it's a court ruling and part of your record looked at by police bg checks. It might even be public record, I'm not sure.

But it's a moot point if it's part of a regular background check record. Nowhere in PL400 would it warrant HIPPA access if being involuntarily committed is known without HIPPA records.

You can choose to release your health info to anyone you want. Nothing unconstitutional about that.
If you were forced to then yes, that's not constitutional and neither is MD's fwding your health info behind your back to have your guns taken away.

Well, we ARE being forced to hand over our HIPPA records in NY in order to exercise a fundamental right. So that IS unconstitutional. 100% illegal for them to require, since owning a gun is a fundamental right. But not according to NYS law.

Just like in Westchester and NYC where they make you give up your 4th amendment rights to own more than 5 handguns. They require you to let them inspect your home. NOT legal.

You shouldn't be forced to give up constitutional rights for ANYTHING. Privacy/4th amendment included.
