In the wake of recent tragedies in New York State and in our country, Governor Kathy Hochul, Majority Leader of the New York State Senate Andrea Stewart Cousins, and Speaker of the New York State Assembly Carl Heastie, took swift and decisive action by crafting and passing legislation to strengthen gun laws in New York State.
The new law makes possession of a firearm in “sensitive locations”, such as airports, public transportation, bars, and houses of worship, illegal. The law exempts retired police officers from this rule. However, the law does not include retired peace officers within this exemption.
Peace officers represent some of the most highly trained and qualified law enforcement officers in New York. These include the tens of thousands of officers that are employed to protect our courts, hospitals, jails, prisons, and schools.
We ask specifically that the law be changed as follows:
Penal law § 265.01-e (3) d is amended to read as follows:
(d) persons who were employed as police officers as defined in subdivision thirty-four of section 1.20 of the criminal procedure law or who were designated peace officers by section 2.10 of the criminal procedure law but are retired;
265.01-d (2)c is amended to read as follows:
(c) persons who were employed as police officers as defined in section 1.20 of the criminal procedure law, or who were designated peace officers by section 2.10 of the criminal procedure law but are retired;

SCOTUS did attempt to stop what they did hence the statement how they can’t turn Manhattan into a gun free zone. But it will take the lower courts to enforce it first.

As far as retired peace officers, they do have an option. The LEOSA exemption can apply to them as well if they qualify every year.

It’s going to get tossed out. They overreached with their new sensitive areas. It goes directly against the standard the court must apply on most of those places. And the fact they didn’t give churches the option to allow armed people ( non security guards) could be not just a violation of the 2nd. But a violation of religion. It was quite common to have a weapon blessed by the church even if another religion would not allow weapons.

Without an injunction, we'll be stuck with this unconstitutional law (that flies in the face of history and the recent SCOTUS decision) until the case can reach SCOTUS in a decade.

It will be faster than that one way or the other. It’s so draconian that some innocent permit holder will get caught up in it. A criminal case can move up a lot quicker than a civil one. Besides, if the state loses an appeal, SCOTUS can just refuse to hear it and the law falls.

Retired Feds under 2.15 aren’t included in new law either, but are covered under LEOSA. Also doesn’t look like off duty out of state are covered since they only referred to 18USC926c. I qualify under LEOSA, but I’m more concerned with friends that no longer will be able to carry with new law.

Most of it will stand. For a long time. Even Texas has article 30-06 or 30-07 where you can only carry where those signs are present. Carry being barred in sensitive places, and very few if any business will allow carrying, essentially invalidating any permit. The Bruen decision fucked everyone who didn’t live in NYC.

No way the "can't carry anywhere" provisions will stand up. If they get lucky and get an honest federal District Judge, a preliminary injunction will be issued. A motion for preliminary injunction is given priority. The NY appeals to the 2nd Circuit. Of course the 2nd never saw a gun control law they didn't like, but it is possible it could follow the SC decision. If the 2nd does not strike it down, will go back to SC. I imagine Justice Thomas is not happy with what NY did. Basically they gave him the middle finger. NY dems had a temper tantrum like a 2 year old when something didn't go their way.

Anyway, I have one more case to try, then I'm retired to Florida and NY can go screw itself. I feel for you who will remain in the people's republic, but I'm gone.

Yep, the 2nd circuit is like that. The good news is that the 2nd circuit wants to put their gun control spin on it and they don’t want SCOTUS to destroy all of it so they might toss most of it, if not all, to prevent another big SCOTUS smack down and take down more of NYS restrictions( made before Bruen)

What I am saying is that while having the LEO or verteran credentials should give the issuing permit officer the warm and fuzzies, it shouldn't put you ahead in line or give you preferential treatment of any kind in this case.

The problem with your argument is that you act as if I am against people getting their CCW. Just the opposite. Equal consideration? Nope. Why? The officer already passed the background checks, has been pressure tested to some degree. The applicant for CCW would be no different than a new police recruit at that point( a lot of police recruits have a lot of experience from all sorts of backgrounds). No warm and fuzzies for police recruits
Military veterans often get warm and fuzzies too by the way.

You aren’t truly understanding the threat against LEOs. We will and have be attacked not just for anything we had direct hand in or an enemy we created. We will be attacked if someone simply finds out what profession we once held. LEO can go on vacation to the other side of the country, completely out of his former jurisdiction, and be attacked by a complete stranger when that stranger learns of his his (former or current ) profession- from minor things like vandalism to physical assaults to attempted murder. It’s so common it doesn’t make the news.
That’s why LEOSA exists.

There's no military or veteran training exemption. They recognize the handgun training you receive in the military as satisfying the training requirement. There's a big difference between that and an exemption.

No one's life is worth more than one's own and their loved ones'. Not a cop's not a disabled veteran's; not even the fucking president himself deserves an ounce more consideration when it comes to allowing him to carry a gun for personal protection, because his life is not worth any more to him than mine is to me.
