It is oft explained you cannot shout FIRE in a crowded theatre.

I believe it is 100% your Free Speech Right to do so.

But then you might be indicted for causing a riot. But you should not be prosecuted for any "Free Speech" violation.

I also believe you can say vile, racist rants.

Or state quite clearly your desire to harm someone.

These are unacceptable things to say, but if they are prosecuted it should not be because they violate Free Speech.

Are contracts with "Hit Men" a violation of Free Speech ? They are not.

There are many verbal statements that are criminal. But none violate Free Speech.

And this is the problem.

The right to Free Speech has been completely corrupted.

Society has criminalized much that it should not.

No speech should be criminal. Some speech can be a tort, but not a crime. Only actions should be able to be a crime.

All speech should be free. Even the speech that another does not agree with. There should never be speech that is considered hate speech. Made up terms to calm down those that have no control of their feelings and emotions.

There are times in which your Exercise of Free Speech can get you in trouble with the law; as it should.

The "gaslighting" left and their media butt buddies have corrupted just about everything they have touched. The term "free speech" is one of those things. They have convinced America that there is no difference between "free speech" and constitutionally protected speech, and we have let them do it.
Your free speech ends at the end of my fist. If you want to insult my wife, it is your right to do so emefer, but then be prepared for a punch in the nose. If you are some mamby pamby that honestly believes that violence is "never" acceptable, you are an idiot.
Now, if you want to curtail anti-government speech or criticism of anything government-related then you are entering a constitutionally protected area in which no law can be passed to restrict that speech. The "press" has even been given "Constitutional privilege" to print that speech and the Government can do nothing to regulte or punish them for doing so.
Now a private person or company can still try and punch you in the nose for your anti-government speech but then that violates other laws and ordinances.
BUT! and this is a HUGE BUT! If a private person or company is acting as an agent of the Government, they both are violating your civil rights and you have every right to resist up to and including violence.
The gaslighters have stolen this by creating several butt hurt hyphenated gender-confused generations of children that don't seem to reach maturity until after they are 40 or so if ever.
Here is a hint. When reading all the current "free speech" stories, replace free speech with censorship the gaslighting changes.

Musk never says he will end the censorship, he just says he will make it transparent. But the gaslighters gloss over that with their own narrative to serve their own agenda.

If you shout fire in a crowded theater, contract with a hit man, or threaten people you are not charged with a first amendment violation. It’s harassment, or attempted murder, and probably disorderly conduct for the theater incident.

Understanding that the biggest offense of all is that humans might restrain themselves from expressing their opinions and true thoughts due to fear of repercussions or lack of acceptance from others.
Listening to things we might not like is not only encouraged but necessary.
We can let them know our disagreement but we always must let them talk.
That is more important than anything else, including and specially our own feelings.

You can be responsible for the results of your speech.

If yelling fire in a theater results in a panic and people get hurt, then you are responsible.

If the only result is people telling you to shut up and sit down, then no harm no foul.

Same with the hit man. You can talk to him all day. Until you hand over money or sign a contract, again, no harm no foul.

Threatening people is a bit less clear cut, but again, if they call your bluff there's no harm. If you react to the threat (leave the area, etc...), then you've been harmed and it's criminal.

You’re correct and that’s why the police wait to arrest until when money has changed hands in nearly all hitman situations and drug deals. No money no contract.

If your boss decides it is disruptive - you are gone. As you would be with any disruptive speech. Even if you are just yakking about Sports all day.

If you get into a fight with someone - that's a criminal matter. But the Police have no right to knock on your door just because you say awful things.

I also do not believe your Employer has any business in what you say or do off the clock.

Belong to the KKK; do drugs - no one's business if it's on your own time.

It needs to be illegal for an employer to discipline employees for ANYTHING they do privately.

If the employee is breaking some law, that's a matter for the police and the courts.

This shit about subjecting employees to drug tests must end.

Many will argue and say the exact opposite. They will state that there is in fact case law. I got into a discussion about this over in the Twitter world.

So many like to bring up Schenck V United States in 1919, and Brandenburg V Ohio in 1969.

Many like to bring up Espionage of 1917 and the Sedition Act of 1918. And, of course they are wrong. They love to Quote Justice Holmes and use only a few words of his statements. They never seem to look deeper nor do they seem willing to read words spoken by him a short time after his decisions. The following is a decent little read on the issue.
