What is the LEO exemption? What can they own that we can't?

As for the OP, LE Officers are exempt from Penal codes 265 and 400. All sections. There is very limitations as to what coppers in New York are authorized to own in regards to firearms, accessories and other types of weapons.

While I do not agree to these exemptions, I use the job I have to own and store all that I can. I do not do it to rub in the faces of others, I do not do it because I think I am better than others. I do not consider myself to be a first class citizen and others second class. I use these laws as to my advantage anytime that I can.

I would be a fool to pass up the opportunity to own these tools.

I do not fault individual officers for taking advantage of what's offered to them.

It would be hypocritical IMHO for me to do so, I have a full carry permit largely by virtue of living in a permissive county, something other people in NY can't obtain.

Just like I do not fault welfare recipients for taking the checks that are offered to them.

But I do find all of the systems like these that arbitrarily divide people into haves and have nots completely repugnant. Even if I end up on the "have" side of some of them.

Well since this thread will be a shit show anyway, I might as well answer the question truthfully.

Silencers and SBR’s are legal for NY LEO’s.

Only while active. The second you retire, that SBR and such are illegal.

These guys think just being able to have a 15 round magazine to a gun that wasn’t necessarily your choice is so great. That gun for me sits in a safe until I have to requal with an occasion range day in between.

And yes, there are some great perks for active officers but big potential down sides as well:
Don’t forget that for twenty or more years, we lived under that “red flag” threat . And not just for what that red flag law is supposed to be about but at the whim of a supervisor who says you didn’t file some TPF report or something.

That our carry guys including off duty were subject to other people’s restrictions. Now that I am retired, I can carry a greater choice.

And yes, there are some great perks such as just being able to walk and buy a handgun in the same visit without a ton of red tape. I miss it. But that “freedom “ for active LEOs in this state is much less than that of a citizen in a free state.

The one retired perk that I am taking advantage of is LEOSA and the statewide permit. But even that is more limited than one would believe. When I go to NYC for a night with the wife, certain places will not let me carry. And the problem of securing it becomes a big issue. A big enough issue that often the choice is go unarmed or don’t go. It was a problem even when I was active but more so now.

I believe that to be just an AR firearm. What I want to know is would an AR AOW with a tax stamp be legal because it wouldn’t be a rifle or a pistol and you would have AOW paperwork for it from the feds.

Right. It’s a firearm that’s neither a pistol or a rifle but an LEO can arrest you for having a pistol because it looks like one.

With an AOW, you would have paperwork from the ATF I’m assuming specially saying that you have an AOW which is not a pistol or a rifle.

Frankly I doubt the lack of respect community I would be concerned with is the CCW community . I doubt the vast majority of the people who openly disrespect cops are lawful gun owners in the first place.

The us vs them mentality didn’t start with the SAFE act or the 1994 AWB. And wouldn’t stop for some even if this was a constitutional carry state. Some people are anti authoritarian and should just own up to that. The gun ownership issues can just be a focal point of it. Other wise it would be “duty to retreat” laws, etc.

And yes I believe the “duty to retreat laws” in NYS would be examined and more exemptions possibly added.

Prior to the Safe Act, I never even gave officers a look. I didn’t see them as bad or good. Just guys that you couldn’t speed around. It wasn’t until after the Safe Act that I took a negative view towards them after researching how willing they were to enforce my rights being violated. The more I looked for examples, the more I found. I was ignorant before. They’ve been doing this since before the Safe Act with the Sullivan laws. I just didn’t realize that it’s been going on for years. I was a sheeple that thought that it was okay to be permitted a right.

Between my time in tourist areas in Manhattan and where I work now (the reddest part of NYC), I’ve encountered plenty while working. In fact, the “divide” you speak of is far more overblown than the one on the street in urban communities. At least its true there that 99% of cops can’t relate to those communities at all. I also take advantage of what I can have while active LEO, but already looking to leave NY after retirement or maybe before. Hopefully the Supreme Court will take these cases and eventually make a ruling against states violating the BOR. I believe any law abiding citizen should be able to have whatever they want. True, They don’t have assault weapons there because that is an American political term. They actually have assault rifles there ( you probably don’t know what that is so GTS) among other weapons like 90mm recoilless rifles, RPG7s, land mines, AKMs and an assortment of Russian tanks. But hey “Assault weapons” are dangerous.

They defeated the Russian Army and took over a lot of their weapons. Every tribe in Afghanistan has enough heavy weapons to take on a US Army Infantry Company. Some have enough to take on a US Army Infantry Battalion.
