They did not give a darn about LEO support. The SAFE act was passed without LEO input at all. Heck, it even banned active on duty officers from going armed into schools without written permission of the schools at one point.

The magazine exemption was granted in part because of cost and guilt. Officers had buy the magazine and were trained by the state in the use of those standard magazines. It’s why the exception only applies to the magazines only to the weapon they qualified at their LEO job with. Basically their service weapon and maybe one job approved secondary gun. It’s not all that.

LEOs do not have a lot of political power.

This is funny because my local PD are running 14.5 pinned rifles with carry handles. And our sheriff's department is running "pistols" with carry handle

I'm just more disappointed when I found out they both agencies are still running carry handles/irons.

Was shooting with one of the local PD at the last match and he mentioned the agency refuses to allow any optics for rifles, had some PA officers with him who couldnt believe it either and that they are agency rifles so they get passed around like the town bicycle

It could be the same with the retired LEOs. Like the schools, the retired LEO would turn into a felon the second they retired. Even if they vouchered their guns for processing, a magazine left at home makes them a felon. See how embarrassing it could be to this law.

They got a concession from law makers because a lot of old anti-gunners tolerate a retired cop having his service guns.

There are a lot of laws that LEOs get to ignore in the interest of "doing their job" where there is no exemption in the law.

To my knowledge there is no exception to the laws against drug or child porn possession for instance, but dozens of cops possess both every time an arrest for either is made.

If you followed the letter of the law, both would have to be destroyed on site and then there would be no evidence to prosecute with.

I thought if we paid the tax stamp for NFA items .. then got permission from the county sheriff too all good ??
just a lot of BS so really never dug into it .. but you know the gangs have mac10's and shit no 4473 or PP ..

No daily penal law for New York says we arent good enough citizens to own NFA items (well SBRs, SBS's, machine guns... iirc @Eddie Gunks was saying something about we can get aow maybe?)

If you fork over the cash for the right FFL you can have whatever you want. But if you stop paying for the FFL it all goes away.

Privately owned NFA stuff is limited to AOWs IIRC.

Actually there is. Both case law and criminal procedure law . The law also protects you if you found child porn while repairing a computer and you turned it in. It’s “transitory “ possession. Also a defense lawyer or expert gets hold such evidence for court purposes and scientific tests.

Political power depends upon Us verses Them. That is why cops and politicians are exempt from laws passed to disarm the serfs. The Chiefs falsely believe that they (their people) will get to keep their guns when it is all said and done.

Generals tend to be for gun control as well, they like the chiefs believe they (the military) will get to keep their guns forever.

Neither of the leaders realize they will not get to keep their guns or their power when the politicians disarm the population. They (both groups) will be replaced by the politicians secret police that are loyal only to them.

As for the OP, LE Officers are exempt from Penal codes 265 and 400. All sections. There is very limitations as to what coppers in New York are authorized to own in regards to firearms, accessories and other types of weapons.

While I do not agree to these exemptions, I use the job I have to own and store all that I can. I do not do it to rub in the faces of others, I do not do it because I think I am better than others. I do not consider myself to be a first class citizen and others second class. I use these laws as to my advantage anytime that I can.

I would be a fool to pass up the opportunity to own these tools.

Colleague of mine dealt with this exact issue when they ran across material like this on a client machine during a completely unrelated corporate investigation.
