What would this firearm be?

So I'm thinking about making my own firearm.

An AR15 style upper and lower receiver
Semi automatic
detachable magazine
pistol grip
barrel with a length of 11.5 inches
muzzle brake
front fore grip
AR15 style pistol buffer
over all length of 27 inches
Chambered in 300 black out

Can't be a rifle/shotgun or short barrel rifle/shotgun because I never designed and manufactured with a stock or to be shot from the shoulder.

Can't be a pistol as it has a front grip.

Can't be an AOW because it's longer then 26 inches.

The safe act only specifically mentions rifles, pistols, and shotguns from what I have read.

So what would this be classified by NYS?

The key here is the 11.5" barrel with a foregrip. This would fall under the NFA AOW, Unless it's being sold as a rifle, it would be an SBR weather it has a stock or not.

As far as NYS is concerned, no NFA items allowed.

No, it would just be a "firearm" like a pgo.

If it's surpassing all the federal and state laws, it would be a firearm I'd imagine. We have "shotguns" being sold that have tiny barrels that aren't NFA or AOW's here in NY state that are classified just as "firearms".

In order to be PGO which suggests it's a rifle,but can't be because of the barrel length, it would have to be classified as a pistol. The VFG makes it AOW.

I realized I made a mistake in the length requirements. AOW's have to have an overall length shorter then 26 inches.

I have not found any law on the books in NYS that bans AOW's. Seems like the one NFA thing we can own in this state. Which makes sense since you can have a Serbu Super Shorty here.

However this would not be an AOW.

So from what I'm researching, there is nothing in NYS law that makes what I want to manufacturer illegal. If anyone can find any NYS law then please chime in.

Sweet baby jesus there it is. I looked at their website and it is perfectly legal according to federal law.

The question is, what about NYS law then? It would be just a firearm correct? And since safe act only specifically mentions rifle, shotgun and pistol then it doesn't apply.

All false.

This above firearm is NOT an aow.

Nfa are allowed in ny. Aow are allowed. So are "other". ie. The above mentioned firearm and lower receivers.

Because you can't have a pistol with detachable magazine, semi auto, and a weight over 50oz otherwise considered an "assault pistol" under safe act.

Also becuase I refuse to ask the king (king andy) permission to excercise my rights. That why I don't have any pistols.

We argued this in another thread. Federally it isn't a pistol because it has a foregrip. It isn't a rifle because it has no stock. It isn't an AOW because it is longer than 26 inches. It is considered a firearm however under federal definition because it discharges a projectile via an explosive. So it is totally legal under federal standards for those eligible to possess firearms.

Under NYS law, it isn't a rifle because a rifle has to be designed to fire from the shoulder according to their definition. It isn't a firearm because under NYS law, a firearm is a pistol, revolver, short barreled rifle, or short barreled shotgun. NYS's firearm definition makes no mention of projectiles discharged via explosives like the federal one does so it isn't a firearm.

So if it isn't a rifle, shotgun, or firearm since those are defined and this does not fit into any of those categories, what is it? A pistol? NYS law doesn't define a pistol so it can't be that either.

It is a piece of metal that they cannot charge you with under NYS law. Only federal laws can apply to it.

Is everyone sure this is legal in ny? If it is then I would want this, with the sig brace instead of the stock

You aren't going to find anywhere in the law that says it is legal. That doesn't mean you cannot get arrested. All it means is that you cannot get convicted via NYS law and it'll cause you money and time if you have to answer to it.

Are we discussing unsafe and "features" or basic legality bassed on lengths and type classification? Assume it is a fixed mag, what could be illegal about it then as per ny?

See post 25. If it is not a rifle, shotgun, or pistol, what Unsafe Act violation can they charge you with via the NYS Penal law?

They'd have to prove first that it was a rifle, shotgun, or pistol and then prove that you had too many features.
