You have to go to an FFL and turn it over to them for the transfer. They give you a receipt so you can have it removed from your permit. They will then give the purchaser a receipt so they can go through the process to have it added to their permit. Once they get their permission slip, they go to the FFL to run the NICS and pick it up.
That's pretty much right but I don't know of a FFL that would give you a receipt before running the NICS check

So you are saying that some counties will put a gun on your permit then you go to pick it up and may get a denied response from NICS? I don't think that is true as I have worked gun shops and would never give a a receipt without a proceed response from NICS. Once the gun shop takes possession not even the original owner can just take it back without a NICS check.
Yes. That is true. I bought a handgun from a forum member here. We met at the FFL. He gives the handgun to the FFL. The FFL gives him a receipt showing that it was turned in to them. He can then use that to have the handgun removed from his permit. The FFL at the same time, gives me a receipt, showing the make, model, s/n, caliber, barrel length so that I can send that to my county to have it added to my permit. Once I get my purchase coupon, I then will then go to the FFL. I do the NICS. Once the "proceed" is given, I can take the gun into my possession.
Yes there is a time requirement. The NICS check is good for 30 days and must be resigned when you pick the gun up if it is a different day than when the check was done. When resigning you are swearing nothing changed from when the original check was done. If you wait more than the NICS check is good for you run the risk of a delay because you have to do another check causing you and most likely the FFL one huge headache.
Its exactly how it works in Monroe County. When I bought my first handgun, I got it added to my permit on a Friday on lunch hour, went to pick it up after work (had range day all planned for saturday) and DELAYED! Worst buzzkill of my life. Didn't get it til Monday.
Of course that’s the plan. They want you to have to keep doing the background check. This is nys and they do t want to make having a gun easy to obtain. They don’t care they don’t want to give you an answer. This doesn’t happen to me but I’d love for some one to challenge it and get it declared unconstitutional.
That’s the federal rule but nys passed its own rule to needed a proceed and allowing for up to 30 days to get that. A NICS check is only good for 30 days so if no proceed by then we just go round and round the merry-go-round.
There are counties that make you purchase a gun before you get your permit. Not sure on the specifics but there are a few.

That is true. You go and purchase the gun, do a background check and then FFL gives you a receipt to take and put it on your permit. In no case have I ever heard of a FFL giving a receipt without doing a background check first. In NY an FFL needs to see your permit or the letter saying you have been approved before selling you a handgun.

Then please tell me what happens if said person has the gun on their permit and then goes to the FFL and do a NICS check and it comes back denied? Can you tell or show me where the FFL can't run a check until the firearm in question is already on someones permit? Yes it must be on their permit before they pick it up but I don't know an FFL who wouldn't do the backround check before giving a receipt so it can be put on a permit. That is just asking for problems that would be difficult at best to straighten out.
Can you tell me where you got this legal definition from regarding the second check and the 3 day wait? I have contacted the head Trooper in Albany and the best answer he could give me on whether that's how it works is maybe maybe not. I have also contacted the NY Attorney General for an interpretation of the the law and have yet to hear from her. Just wondering where you get your information from.
