Has there ever been a pure unSAFE Act arrest that led to an actual unSAFE Act conviction, or did they, as usual, offer the perp a lower charge as a "deal" to prevent it from ever being challenged in court?
There is a case in process currently.To my knowledge there has never been a "pure" SAFE Act arrest. Someone please correct me if I'm wrong.
Not a pure safe act. The rifle had THREE ( pistol grip, a forward grip and a flash suspensor ) evil features as well as 30 round magazine. I believe it was illegal before the SAFE act.There is a case in process currently.

The old law has no bearing on the new one. But yes we can assume that it was not a pre '94 since DD was started in 2000ish. The 30 round mag very well could have been a pre 94 dated GI mag, or it could have been a p-mag made 6 months ago. We do not have that information.Not a pure safe act. I didn’t mention the magazine for the very reason you mention. But the rifle was illegal before the safe act therefore it’s not a pure safe act violation.The old law has no bearing on the new one. Without more information we dont know a lot of things. Was this brought in from out of state in that configuration? Was it mag locked and then converted? Was it mag locked and in compliance, but they dont care? Was it purchaced when he was LEO and it was ok for him to buy?
My biggest question is who plunks down $2K+ on an "illegal" rifle, but only has one 30 round magazine?

Yes there has been. I’m aware of a few but they were not prosecuted. I know a lot of cops and a guy was selling guns without background checks but the judge tossed it because he wanted a jury trial. Yeah, I find it very difficult to believe that NY, with their draconian laws ,would arrest you for having an evil, scary looking , baby slaying, fully featured “assault “rifle , then lower the charges to something minuscule, and then give you your death machine back to bring home. If that’s the case , the arrest was bogus from the start. Arrest you for something, charge you for something else, and then give you back what you unlawfully possessed and were arrested for in the first place????? Just don’t see that happening,Do they actually return the person's property?
