I have a NY pistol permit and want to take a freind to fire one of my handguns at my clubs range. I had this lawyer guy who is a friend of a friend say that's not legal in NY. Its my gun on my permit at my clubs range. Is that NOT legal? tried googling it got various results. I wouldn't think they have to have a permit to shoot my gun with me standing right next to them. Seems stupid BUT this is the communist state of NY.

If you want to be technical. IIRC (ianal) even if your friend had a New York license it is still illegal for them to shoot your handgun unless it was also registered on his license.

If you go to the firing pin range in burgus you have to have a PP to shoot a pistol there ..
There is an exemption if your friend is at least 14 but not 21 or older and you are an NRA pistol instructor... but otherwise illegal for your friend to be in possession of a firearm without exemption.

I thought there was some debate as to what constitutes "possession" in the legal sense. I know in the real world simply holding an object does not constitute "possession".
If you are a NRA certified instructor at an NRA certified range. You can train him and he can shoot your pistol. I think this is how the law is written. Please correct me if I am wrong.

I still want to hear a legally inclined member clarify what constitutes possession. I know that simply holding an object is not legally considered possession. Therefore if NYS defines possession of a firearm differently than for other things or differently than standard legal precedent a lawsuit should be filed. We should be filling lawsiurs around the clock, appeals around the clock attacking unjust and illegal firearms legislation from every possible angle. And all of us need to start putting up the money to finance these efforts. Send money to each and every fight in each and every state, county city and town.

I really just don't see how allowing someone to handle and shoot my pistol While I am standing tight there counts as that other person possessing my pistol. Furthermore I have always thought it utterly ridiculous that a shop will not allow anyone without a permit to handle a pistol. Picking up and examining a pistol at an shop under staff supervision is most certainly not possession.

If memory serves and if I'm wrong I apologize - @Eddie Gunks had obtained an opinion from his local DA's office as to the "handling on a shop's premises" thing (answer was it's ok to do so). I would imagine your mileage would vary jurisdiction to jurisdiction, since this state appears to have no interest in equal protection statewide (see also: Sullivan Act, application thereof across different locations in this shitbag state).

I have always thought that gun shops in NYS won't let you handle a handgun w\o a permit because "you can't buy the gun, so why waste my time."
As @Podmonkey has said the laws are intentionally vague. What is possession and who will decide? Read the laws and make your own decision.
