Cuomo to announce new regulations on work schedules for hourly employees
ALBANY — Gov. Cuomo plans to announce sweeping new worker scheduling rules Friday that call for employers to set employees’ schedules two weeks in advance, the Daily News has learned.

The new regulations stop short of prohibiting what’s known as on-call scheduling but require most hourly workers to receive an extra two hours of minimum wage pay for assignments received without two weeks' notice.

They also require employers to pay at least four hours for shifts that are cancelled within 72 hours of their start time.

“The regulations advanced by the Department of Labor will increase fairness for workers and allow employers to retain flexibility,” Cuomo said

It does exempt cancellations that are due to "an act of God or other cause not within the employer’s control."

This is going to put a serious hurt on all kinds of business. My wife works at a large Grocery Store, this is going to end up hurting the worker just as bad as the employer!

I am curious of how something like this is going to effect my employment. We have to have a minimum number of people working each shift. If there are too many sick calls or over scheduling of time off, those of us at work are Forced to work the next shift.

Forced OT yup used to happen when I worked the powerhouse at Cayuga Correctional Facility. A guy would want to go snowmobiling, he would call in sick and I would get stuck working a double.

I own a service construction company. I don't know schedules because of last minute changes or weather. So I guess I will schedule my crews for 32 hours per week and see how it shakes out. I'll just tell my pissed off customers to call Andy. FUac

The two week thing for a schedule has been in Civil service for decades. It can cause issues because if you legally refuse a schedule change , it can be hell later down the road. The two week notice was/is nullified if a bona fide mission requirement in my experience

Well, surely you dont think that only 1 profession in this world would have people with those characteristics?

Not sure how old you are and how long you have been in the workforce, but when I was younger I would have thought no one would do such a thing simply because i wouldnt. Only as i became older and wiser i realized that many people in this world are not honorable or loyal and will quickly rat out the person that gives them a payceck if they feel slighted.

I happens often, and if you dont think some mcdonalds worker wont report mcd's you are sorely mistaken.

Its sad, but true.

Service sector employees will be the most affected by this rule. And quite honestly, being "on call" and not being able to rely upon a set or given salary for your work, or job is a byproduct of the entire "temp" employment industry which coincidentally will probably evaporate with this regulation. It's an abusive practice with little doubt and only a benefit to the employer to have employees in "stand by" mode just in case you need them. I don't see an issue here, as it will force employers to maintain a regular and reliable work force, geeee, like the old days! Imagine that? That I actually knew how much money I am going to make this week. That said... Paying for "show up time" with no productivity or activity for the employer is a bit much, can see abuses there too. Biggest trouble will be instituting all these regulations as the trail blazer, and it will cause NY to be non-competitive for a slew of jobs that will most certainly move out of State to a more hospitable environment.

Schedule your crews for 32 hours a week and you will loose all your business to scab contractors that pay illegal immigrant workers in cash.
