my wife was denied her ccw permit today after having to come in front of the judge for rensco. Apparently she has pretty much the worst antingun judge we have in the county. She works for the pba and will even be doing gun events through them in the future for members. Is it similar to the denial for a regulars permit were you only have like 14 days to get a lawyer and file a motion or can you simply try again say 6 months down the road .

Did this Anti-Constitution Judge give proper(?) reason? If so, what did he have to say about it?

We have the same problem here in Westchester. Nobody seems to "have a need for a concealed firearm."
The problem is: When you have a real need for a concealed defensive firearm, it is too late to have a judge deliver one to you.
Waste no time. Research and hire the best lawyer you can to fight this before time for appealing it expires. Please keep us posted, and good luck.
Didn't know we had a bill of needs in this country. Also didn't know the government was responsible enough to tell us what we do and do not need. Should file suit in federal court the county is violating your Wife's 2A rights.

Definitely fight it. If you don't, and she decides to try again a while down the line, she will have to check the box that says she has been denied before.
You could always try to see if they will give her one with restrictions. Then, eventually she can try and have them removed.

I don't get it at all . She's been a nurse 10 years going back to school for her RN with a bachelors graduting June this year . Has never been arrest can own guns and pistols just can't carry even though her work wrote a letter requesting she get it for work .

Damn! He's my judge too. I remember Charles saying to me when I initially picked my permit up, that:
A. You don't have to wait a full year but that they like to see some time between getting your restricted permit and asking to have restrictions lifted.
B. He said McNally likes to see that you have an in depth understanding of article 35 of nys penal law regarding self defense and use of deadly force. Also that you've taken classes on self defense with handguns Etc.. I took that to mean more than just the required safety course.
I don't remember him saying that McNally doesn't lift restrictions or that he required good cause. Idk. I think I'll be calling Charles to ask. I don't want to go through all that just to be denied.

It may just be worth contacting a lawyer and explaining the situation. You never know, there may be options. I don't remember ever hearing "good cause" being needed here in Rensselaer county, just the wait and the advanced safety course. I would certainly contact the clerk and see what you can find out. Did he say anything else to her that may help explain his reasoning? Did your wife happen to ask what McNally considers good cause? Did she take any other handgun classes besides the advanced course? Did she show understanding of the penal law in her letter? I'm just asking to try and weed out possible reasons for him denying it to her.

Can have laws prescribing hamburgers and expecting citizens to give you steak just because that's what you want!

It would certainly put us in the peruta situation. You can't deny both open and concealed carry. McNally was elected in 2013. Before this I'm pretty sure he was a district attorney for Rensselaer county.

Bs, but shes not alone. Ive had my "unrestricted carry" request denied twice in spite of being a Certified NRA Pistol Instructor, RSO, having 2 other out of state ccw's, and having multiple firearms training classes that cover article 35.
Judges both said i did not establish good cause.
Btw, your original post is mis leading as you say she was denied her permit, so that threw up red flags for everyone.

I'm curious to know more details, because if she did things in an off way (and I'm not saying she did), perhaps that could have effected the decision. By that I mean, what I remember Charles at the clerks office telling me, was that he is more of an intellectual and likes to see a "Resume" so to speak, of experience (classes, training, Etc.) and that you have a firm understanding of article 35. He mentioned nothing about "good cause". That would have sent chills through me. But also, with the enormous influx of new applicants, it could be things are changing and they are getting ore picky about who gets restrictions lifted.

This need has been backed by Liberal Progressive judges all the way to the second circuit, until 2 new pro 2A judges reach SCOTUS bringing it anywhere other then local is a waste of dollars. The local lawyer for a relatively small fee bets option.
