In a sworn affidavit, a woman tasked with serving court paperwork to Erie County Executive Mark Poloncarz says the county executive threatened to shoot her.

May not have been a wise move by both parties.

It was a poor choice of words. The last time someone uninvited pounded on my door and I asked if they were trying to get their asses shot off, I soon heard gunfire.

Similarly, she made a foolish potential life altering choice. If someone walks around to my backyard opens my gate enters my porch and approaches my backdoor and pounds on it less than an hour before sunset, a number of ugly potential possibilities come to mind.

Don't know the layout, but if she opened a secured door or gate and entered a back porch it could be a life changing mistake.

Correct. Several attempts were made at the front door first. The investigator then went around and observed the defendant through a window.

The sworn statement indicates threats were made even after the investigator identified herself and her official purpose for her visit. I just listened to a radio segment on this so the details are fresh in my mind.

No doubt. Sounds like this woman did a great job getting some tough work done.

Of course, I’m sure she also knows that deadly force cannot be used in such a situation A: because she was there on official court business and B: because even if she wasn’t, deadly force cannot be used in defense of property or to “remove a tresspasser” (see disclaimer A).

Also she would have to be a zombie to not know exactly whose house it was and I’m sure that played into the comfort factor a bit. It wasn’t a random house where you don’t know the background of individuals living there.

Also one of the local LE agencies were advised ahead of time that this would be taking place.

Harassment at a minimum. Did he cause alarm to another? Sounds like it. Of course nothing will come of it. Too bad she didn’t have a body worn camera activated. It would have been fun to see Marky all worked up.

He sometimes talked about the New York association of Process Servers and their Code of Ethics and guidelines. This lady may have pushed the envelope and took an ill advised short cut to save time.

News feeds are ripe with process servers being killed or injured by both pissed off recipients (often in domestic cases) or being mistaken as a threat. That, as well as their lobbying to prevent Federal or State legislation limiting their practices, is apparently the foundation for their Codes, Guidelines and information sharing blogs.

I don't buy her story inferring she is a blameless victim, but I do enjoy reading a politician, who sounds like an asshole, get his blue liberal tit in a ringer.

Yup, certainly may be an issue. Process servers have told me they are not to open any closed doors or closed gates of privately owned homes to gain access unless it was to open an unlocked gate intended for public access to the normal entrance.

To me it sounds like there is a fair chance she took a short cut to save time since most servers get paid for each service and not by the hour.

Full disclosure: I view politicians, lawyers, used care salespeople, liberal arts professors, process servers, tax auditors, bureaucrats, call center workers (fund raising, auto warranty, poll takers, etc), whole life insurance sales people, much of the Healthcare Industry, and door to door solar panel sales people as leeches on society.

Even if so, it doesn’t support what he did. She identified and was there on official business. A gun threat was then made.

Should she have sat in her car out front for xx hours or days until he came out? I don’t think you would be very effective at her job.

Not so sure about this. It is my understanding that she also works as a PI. She would want to limit her exposure to not affect her ability to work future cases and to conduct surveillance undetected. The pat thing she wants is her face to be known to the public.
