Of course, I’m sure she also knows that deadly force cannot be used in such a situation A: because she was there on official court business and B: because even if she wasn’t, deadly force cannot be used in defense of property or to “remove a tresspasser” (see disclaimer A).
Also she would have to be a zombie to not know exactly whose house it was and I’m sure that played into the comfort factor a bit. It wasn’t a random house where you don’t know the background of individuals living there.
Also one of the local LE agencies were advised ahead of time that this would be taking place.

As far as I know PI’s serve papers so we could both be right.Not so sure about this. It is my understanding that she also works as a PI. She would want to limit her exposure to not affect her ability to work future cases and to conduct surveillance undetected. The pat thing she wants is her face to be known to the public.

She escalated the situation by this unexpected suprise imposition and I won't buy the story that she had no choice. She took the additional risk to save her time.
I have little doubt if a stranger showed up similarly on a porch of a fenced yard suprising many inside their home, that most would not be offering tea and cookies but could offer some colorful albeit different language.
I would be suprised if a DA would criminally charge a home owner for most similar verbal scenarios.

Telling someone they're lucky they didn't get shot is not the same as saying I'm going to shoot you. If he has security guards on the property as has been suggested he could have meant one of them may have mistaken her for an intruder and shot her. He's a putz for sure, but from what I read in that article it doesn't sound like he actually made a threat.

Although it has no bearing on having to protect your family or self from serious injury or death by an intruder, secured back porches came up in subsequent insights on legal exposure from counsel about what can constitute inside your home in NYS.

Full disclosure: I view politicians, lawyers, used care salespeople, liberal arts professors, process servers, tax auditors, bureaucrats, call center workers (fund raising, auto warranty, poll takers, Nigerian Royaly, etc), whole life insurance sales people, much of the Healthcare Industry, anyone who wants me to adopt their religion, and door to door solar panel sales people as leeches on society.

They did just recently try to remove his emergency powers. The vote failed. Republicans are powerless to stop any of this in Erie Co and NYS.They wouldn’t bother to use it anyway.
