Yeah that's how I read it too. It's almost as if the NY law was written in such a way to try and hinder people from purchasing firearms. Hmmm...that doesn't sound like NY at all <sarcasm>.

There is no overlap. If NICS doesn't clear, you have to wait 30 days. After that 30 days, the old NICS is no good and the process starts again - no gun for you!

I don't know how it plays out on the Fed's end as far as following up on delays. As a buyer who gets delayed half of the time, I won't be the slightest bit bashful about asking the FFL to follow up though.
I think it's only happened to me once that there was never a follow-up (that I heard about) after a delay. Usually the Proceed comes within a day or two and sometimes on the same day.
Just another bullshit law enacted by antigun pukes under the false premise of public safety.

have told this story before. Back in the 90's I went to Beikirch's and they ran me through a NICS check on a hand gun and it came back "denied" I was in shock. I thought someone had revoked my permit ( for no reason at all) the guy ( I forget his name) said "don't panic, lets give it 5 minutes" 5 minutes goes by and he calls again....approved? WTF was that all about. I have purchased a few guns since then without incident. But if the check comes back denied, wait 5 minutes, it'll change LOL

I have a really common name so my check usually takes a while. I would say about 15 minutes. I even provide my social. I've never been denied but there is always that thought when it takes so long. I wonder how many people actually go in to a gun store and try to buy something and are denied. I believe it's actually a crime to attempt to purchase for a prohibited person, but do not believe it is really prosecuted very often.

According to my doctor, he has 6 people with my exact name as patients.
For most of my life I was delayed for the full 3 days. Out of probably 50 gun purchases, I had maybe 3-4 proceeds ever.
Then I got denied in 2015.
After fixing that I got a UPIN number.
Sinse the UPIN, my last 4 gun purchases have went through in seconds.
I know alot of people frown on UPINS but im already on probably 36 lists....whats one more.

One of the guys at work gets delayed pretty much every time. It sucks when he buys out of town and has to go back a few days later to pick up.

I say run one nics. If delayed run a second one two weeks later.
If the 1st ine does not get a denial after 30 days transfer it on the second nics you ran.
this satisfies both state and fed you waited 30 days with NO denial (ny) and you transferred it within 30 days (on the second 4473....feds)

I seem to be having trouble with my reading comprehension these days. It was so much easier when it was "shall not be infringed".

You have to apply for a Voluntary Appeal File (VAF).
You send for the VAF packet which includes the application.
You also need to send a set of fingerprints with application.
Any police station will roll your prints. Our local PD did it for free, some charge a small fee.
Then you wait.
With a UPIN the NICS keeps the information from your last gun purchases so its much easier for them to check your background. They only have to go as far back as your last gun purchase because they know you were good then.
Some people dont want the FBI keeping their gun purchase info on file.
Normally, your info is deleted right after you get a proceed.
No, anyone can apply.
They suggest if you have been delayed alot it might be useful.

So in that case, its no big deal to get a UPIN.
I personally dont care, NYS already knows I own guns.
I trust the federal government a tad more than the state.....but just a tad.

Pretty sure the gun sales from the various dealers on Broadway in Newburgh are not impacted or delayed at all.
What I can say that was a huge surpise too me is that during my denial appeal, everyone at the NYS DOJ and everyone at NICS were very friendly and helpful.
NYS assisted me way beyond what they could have.
I had a 4th degree criminal possession of a weapon charge and was originally told by the FBI that I would most likely never be able to own a gun because NYS is a miserable anti gun place.
Well, the NYS DOJ went far beyond their duties to assist me.
The courthouse where my charge originated lost all their paper files in a move and the judge had been dead for 20 years.
After a month of looking, NYS found my paperwork, which had not been moved to a computer, so it was in a paper file somewhere. They worked with our local judge to get me a Certificate of Relief.
Ha, NYS never ceases to amaze me.

The insidious part is that the ATF stops looking after 3 days.
A proceed or deny will never come on day 4-30.
If you do not get your proceed in the first 3 days it's just not coming.
Better to have them just run it again.
