NY State Senate Bill S1320

AN ACT to amend the penal law, in relation to the sale of ammunition for
assault weapons

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Subdivision 4 of section 270.00 of the penal law, as
amended by chapter 180 of the laws of 1997, is amended to read as
follows:
4. Sales of ammunition not prohibited. Nothing contained in this
section shall be construed to prevent, or interfere in any way with, the
sale of ammunition for revolvers or pistols of any kind, or for rifles,
shot guns, or other arms, belonging or which may belong to any persons
whether as sporting or hunting weapons or for the purpose of protection
to them in their homes, or, as they may go abroad; and manufacturers are
authorized to continue to manufacture, and wholesalers and dealers to
continue to deal in and freely to sell ammunition to all such persons
for such purposes. PROVIDED, HOWEVER, THE SALE OF AMMUNITION FOR ASSAULT
WEAPONS, AS DEFINED BY SUBDIVISION TWENTY-TWO OF SECTION 265.00 OF THIS
TITLE, SHALL BE LIMITED TO TWO TIMES THE CAPACITY OF AN AUTHORIZED WEAP-
ON OVER A ONE HUNDRED TWENTY DAY PERIOD. FOR PURPOSES OF THIS SUBDIVI-
SION, "AUTHORIZED WEAPON" SHALL MEAN A WEAPON REGISTERED IN ACCORDANCE
WITH SUBDIVISION SIXTEEN-A OF SECTION 400.00 OF THIS CHAPTER. NOTWITH-
STANDING ANY LAW, RULE OR REGULATION TO THE CONTRARY, THE VIOLATION OF
THIS SUBDIVISION SHALL CONSTITUTE A CLASS E FELONY.
S 2. This act shall take effect immediately.

So? If you have a registered "assault weapon" such as an AR-15...don't buy ANY ammunition for THAT firearm.

Instead, buy .223 rounds for your Mini-14, bolt action rifle, or NY-compliant rifle.

This is yet another piece of legislation written by legislators ignorant of firearms. The proposed legislation does not make mention of any specific caliber. So, buy all the .223 you want...just not for your registered firearm.

Oh...and without the ammunition registration database...how the hell are they going to track ammunition sales?

Relax...this is just moronic blustering from an ignorant Leftist pandering to their base.

At face value, this bill is:
  • Not practical (since there is no ammunition database)
  • Not enforceable (since ammunition sales are not tracked, enforcement is impossible)
  • Not sensible (since sales of "rifle ammunition" is only restricted by the age of the purchaser, anybody can purchase whatever they want in whatever quantity they wish without having to even own a firearm).

My issue is simple, it's 1 more piece of worthless anti 2a legislation that puts another poorly thought out law on the books setting the stage for future laws to further limit our constitutional rights. They won't stop after this. They will just keep pushing more.

Until they make it a felony to posses more than that. So if you have it sitting in your basement then your screwed. I know I know who would ever know, but things happen. Like my carbon dioxide detector going off the other night. My wife called the fire department. All my ammo was locked up and hidden, but if it wasn't and they make 21 rounds of .223 a felony well I could be screwed. We need to fight instead of just saying well we just need to hide it or not follow it.

Yes but where does it say that you cant own .223 ammunition? I mean .223 is a popular hunting and sporting cartridge so no problem there.

In reality this is legislation for the point of making legislation. The only way to possibly enforce this is if a person has only registered assault weapons in the caliber possessed and no other weapons capable of using that ammo. I mean who on here does that apply to?

It's another stepping stone eroding our rights. This will be used in conjunction with other charges, or as a reason to establish a tracking database.

so how is this going to work with 22 lr ? they don't cell 20 rounds of 22 lr do they and last I knew there was 22lr that qualified as there dumb ass assault weps.Fucking idiot tax payers in this state better wake up soon,this is going to snowball into a shit ton of different ammo in short order.

Heres the way I look at it. the more steps this legislature takes to take my rights away, is one more step for me to get closer to moving out of this craphole state.
