Yes, its a long road with many turns, ruts and outright dead ends. Bad decisions outside of the constitution, and even constituted authority are nothing new. The difference today it seems to me, there are agenda driven justices on the court that do not care one whit about the constitutionality of their decisions and have unashamedly expressed such. Marshall may have been wrong, but was he making his decision based on his vision and understanding of the constitution or was it a power grab for his branch of government. I vote the later.

The founders never intended and warned about making the supremes the final arbiter's of what is constitutional. Congress long ago gave up vetting new legislation against constitutionality before enacting, it has come to throw the shit against the wall and see what sticks.

Congress abdicated their constitutional duties and SCOTUS reacted to the shit that was shoveled on them. The founders didn't design it to work like this and it has fostered the subjective, partial, and politically bent court we have today.
Frankly, every law from the legislature and every decision from SCOTUS is now questionable - Whether you agree with it or not.
