I have a serious question;
Since I cannot possibly keep up with and correctly understand everything that has been signed into law, I ask you : Is it in fact still legal to possess a rifle that was constructed from an 80% receiver and has no serial number assuming that it is otherwise NYSAFE compliant ?

Being that it's in NY... who knows. That's the problem I see with all of this post Bruen stuff. There are victories here and there but they are localized. At most they are affected at the state level. With that in mind, even if something is made to blanket all 50 states, states like NY and CA will still defy it and jam you up. There is no accountability for the treason either.

I'm aware of that ruling, but I want to know right here, right now in NY, is the posession of a rifle that was privately made from an 80% lower, and has no serial number but is otherwise state compliant, legal ?

When you get a firm grip on New York's firearms regulations, please let the rest of us know.

No. Has to be serialized. Read:

Assembly Bill A8786​

and

Senate Bill S14A​

We are past the 180 days when the law from 1/6/22 went into effect (in July).

A NYSAFE compliant lower receiver (gun) that is not serialized could be taken out of state to have it serialized by a non-FFL engraver. That would likely not conform with the law, but no one would know if you had it serialized prior to the law taking effect or not.

Of course, all the components other than the lower receiver are OK to have.

Federally, a 100% lower can only be engraved by a FFL. There is some grey areas if you could find someone that does it while you wait, but for sure if they keep it overnight they need to have a license.

I have had some engraving done while I wait. If you write up everything you want ahead of time and have a brief conversation, it doesn't take long. Just call ahead to make sure they can do it while you wait. Also, an out of state engraver or FFL that engraves would not need to register your gun with NYS.

I cannot find the thread but there was a recent article on the Supreme courts view of what is considered a gun, and if I interpreted it correctly, if you have what is called a 'Ghost gun' receiver and it is in parts it is not to be considered a gun. Was that a formal declaration or just a Q and A session by the court?

I think it was just a hearing.

The decision will probably be released in May or June.

The bill has this beaut in it:

§ 5. Section 265.10 of the penal law is amended by adding a new subdivision 8 to read as follows:
8. ANY PERSON OTHER THAN A GUNSMITH DULY LICENSED PURSUANT TO SECTION
400.00 OF THIS CHAPTER WHO ASSEMBLES, MANUFACTURES OR CAUSES TO BE
ASSEMBLED OR MANUFACTURED, A FIREARM, RIFLE, SHOTGUN OR UNFINISHED
FIREARM FRAME OR RECEIVER IS GUILTY OF A CLASS C FELONY.

This is irrespective of whether the gun is serialized or not, whether it's a serialized firearm frame purchased with a background check, or an unfinished frame that is serialized and "registered" under this law and then finished. "Assembling" a gun from a serialized frame or receiver for your own use would require a gunsmith license.

Reading that Law and it's predecessor, I wondered how Gun Manufacturers got away with manufacturing Guns? I do know Remington moved Handgun and Bushmaster (and the other names) to Alabama because of the Laws...hell, rumor has it most of the employees at Big Green probably couldn't pass a BGC or a Drug Test.
A "Gunsmiths" Licenses, is the same Application and requirements as a NY Firearms Dealer (Handgun Dealers Licenses) additionally, a FFL is required FIRST before applying for a NYS Handgun Dealer/Gunsmith Licenses can be applied for....think about it.
