Gotta tell ya, it is indeed assault. The little bastard that kicked out the chair did in fact break the law. It is not up to him to decide who sits or stands during the pledge.

I promise you, if I were to witness this while at work, the chair kicking turd would be in handcuffs and offered a free ride.

Let this be my child that the chair was kicked out from, there would be serious hell to pay. His family would be screwed in more ways than one.

When I was in school there were actual fist fights. The cops were never called to the school.
The school disciplined the kids involved in the fight and that was the end of it.
It was a rural school, I don't know if that makes a difference or not. Or maybe the time period.
This was during the 70s and things have obviously changed.

I don't recall ever seeing cops at our school...
If that was my kid I would have let him handle it on his own. But I would have taught him how to deal with a situation
such as this... Just like my father did with me.

Possibly. Yes. In NY State, a minor, for the most point, cannot be sued, but the parents of that child can be.

Use a better example, punk kid, like the one in the video, punches another kid in the mouth. The kid that gets hit has braces. The braces are damaged and replacements are going to cost 2 grand to fix/replace. The parents of the aggressor are on the hook for that damage.

Unless tried as an adult correct?. This kid had to of been over 16 and that is the age where you get tried as an adult. Most states are 18. So now I don’t see how the parents now get hooked for the damage.

Would you like to bet that the kid that fell from the chair has a bruise? Look closely at an x-ray of his pelvis and you could probably find a hairline sacral or coccygeal fracture. So, with an injury and intent...voila...ASSAULT.

The real issue is with what could have happened. It would not be difficult to imagine the kid knocked off of the chair hitting his head on a hard floor and winding up with a closed head injury (ex/ subarachnoid hematoma) or skull fracture.

The action by the guy who kicked the chair was reckless and dangerous. Period!

No one suffered from screwed up braces, fractured skulls etc.
Everybody was back in school the next day with a couple more bruises is all.

I would have asked him what he did about it to make sure that it doesn't happen again any time soon.

Just for clarity I was not a bully in school, but I was a tuff kid that knew how to fight.
I would sometimes stand up for the kids that were being bullied in school because I felt bad for them.
My two older brothers bullied me at home when my parents were gone and I knew what it felt like.
It's an awful feeling to feel vulnerable... But I took it upon myself to change that and I did.

The few times that I have been bullied have made me the man that I am today. My parents used to tell me if someone hits you you hit them back. We'll deal with the principal.

Okay and if that person started to fight the guy that kicked his chair we wouldn’t start complaining? If he did go for him good for him. Overall the kid got what he deserved and the kid could’ve caught back.
