I go back and forth with it. I agree with what you are saying but I also think AWB's need to be put down for good. The only way to achieve that is to have one struck down. Yes, we could have awb's in individual states struck down, and I think we will see that. However, the federal government needs to have their ban (or their idea of passing one) struck as well. I feel like now we are at our strongest and in the best position to get an awb struck down.
What I am unsure of is if all the individual state's bans are struck down before the feds manage to pass theirs, would that affect anything with their ban?

I have a feeling that if the feds do pass a ban, you will have actual states suing the feds over it as well as pro gun orgs. I could be wrong, but having actual states in the fight could get it infront of the supreme court faster.

I think we'd be in the same situation we're in with marijuana. Federally it's still an illegal drug but many states have made it 100% legal within the state. It would circle back to what Coolone said where states will not enforce it. If we are honest this is what NY is doing but not in the way we want it to. So if the power is ultimately with the state then the only solution is to move to a state that is free. It would all boil down to how badly the Fed wants to enforce a national ban and if they have enough resources to do so. Hint the DO NOT have enough resources to effectively enforce a nationwide ban.

Feds 100% have the resources to shut down manufacturers and ffls and that's all they need to do.

Also how much the state wants to step on the ATF's toes in its effort to raid ffls. I don't know what if any reaction/response the DEA had with states allowing dispensories and/or making pot legal in their state, but I fear the ATF will be more involved...makes me wonder if states will try the 10th amendment and commerse clause, kind of like the Texas built suppresser thing going on. Where guns manufactured in the state and sold in the same state are untouchable to the feds because it isn't interstate commerce. You'd have state sanctioned gun dealers instead of ffls.

The courts are NOT the final arbiters of American Liberty, and they never have been anymore than Fedgov is or could be.

The courts were utterly useless on the Second Amendment for close to an entire century, so that ought to be a big red flag that highlights the fact that the courts are just as political and prone towards less Liberty than more. In other words, trust in the courts is not something most of us should have. Many times in the history of this nation the courts have gone completely the wrong way, and not only failed to uphold the Constitution in any given manner, but have in fact ruled against it and perverted it. This is easily demonstrable and obvious.

Further the courts ultimately have little power to enforce anything they rule upon. They can write opinions and make rulings, but unless Fedgov enforces those rulings, they are meaningless. If SCOTUS ruled tomorrow that almost all gun laws were unconstitutional and overturned, who in hell is going to enforce that and uphold the Rights of the People?

Carry open or concealed, NO LICENSE!!! None. There are a few other states that are close to Constitutional Carry, getting us to about 30 states. Then there are a number of states that are unrestricted long guns, and relatively easy Shall Issue concealed permits, with NO permit at all to buy or own a handgun. We're talking 35 states here, and you're saying most these gun owners "stay home on the couch too afraid of fed taking their guns away."

That is freaking absurd! Those gun owners worked their political systems and have mostly unrestricted access to everything that does not require an ATF approval and a tax stamp.

The people in 35 or so States have clearly spoken and have been engaged to the point that 70% of the states have either completely ditched their licensing schemes,, or have made them easy enough that anyone who is not a felon or otherwise prohibited can be carrying a handgun in a short turn around.

That is demonstrable evidence that gun laws in most of the country are going in the opposite direction than states like NY and Commiefornia.

The question I was asking (and you have yet to answer) is when was the last time that citizen army rose up and actually fought back with arms? I wonder how it would effect the 80% industry because you would see an explosion of homemade silencers. Those components are easier to get than receivers.
