I think he already explained why in previous posts. Regardless, rifle to pistol isn't the issue here. It's whether you have a pistol as per NY law. The semantics argument of whether it was a rifle first is irrelevant to the firearm in question.Funny. As long as a lower is transferred as an other or a pistol, it can then be made into a rifle and back again. Not so for a rifle. This particular thing has been solidly decided already.

Perhaps somebody should make a sacrificial test case. Make the weapon described in the OP. Take it to the range and purposely get arrested for it.
Then, after getting some sort of ruling what it is, jump the shark, open the receivers and reveal the weapon to be not anything they said it is, but merely an 80%!

I have 5 select fire weapons. I use them at various ranges and "in the farmers field". I drive around with them. I have even shot them in another state. No one has ever queationed me...let alone considered arresting me.....YET! And these babies tock and roll! The AK usually makes the neighbors call.... i guess i should throw down on a can for it already!
Oh! And i have cans for all of em but the ak. Still no trouble. They dont even inquire.

I guarantee you run my 1919A4 for a few minutes and someone is gonna helicopter out to you in a Blackhawk and take your ass to Rikers Island.

Easy.It requires an FFL. $200. It requires the ability to work out of your home or a business location that allows the sale of firearms.
In SOT. $500 per year.
If you want select fire weapons basically the only way to do that is to have a manufacturing license 07FFL. Regular 01FFL can only have select fire weapons if they have a law letter.
You have to pay ITAR yearly, $2250 for the manufacturing of firearms.
10 or 11% excise tax for every rifle pistol shotgun or any ammunition that you produce.
Then you would have to pay insurance. Insurance premium is based on location how far from department/ hydrant and how many guns you produce and sell a year, etc. etc. . They usually start 7 to $10,000 a year.
And then of course, the acquisition of all the fun shit.

It's not legal for me to bring it from CT to NY. I think having my Class III collection in NY is like 10 years and $10K fine per piece. Or something horrible like that. That's why I say Uncle Sam would come immediately to the site of the sound. I used to run my 1919A4 in GA (along with my other stuff) and the neighbors would complain. County Sheriff would call to check if I am running the machine guns; but wouldn't come out. They knew I had a range on my land and I suspect they just have to check the BATFE registry somehow to confirm what weapons are registered to that address. You put your address on the application for the $200 stamp. When you get the stamp your address is on there too.

It should be perfectly legal for you to ship it to any licensed class 3 manufacturer for a "function check".It runs about 800 rounds a minute. You can't shoot it at my mom's in CT - she doesn't have a range. We need to run it here in NY on my range; but we have to make sure that's legal to do. I'm not convinced it is - that's why I left all my Class III out of state. I'll research it.

I can posses/repair/gunsmith any title II weapon (NFA) except destructive devices. I have a fed license for them and a nys exemption/license.
Bullet Guy beat me to it, but it does, it really does. You saying it doesn't, doesn't mean anything. Unless you paid your 200$ tax to manufacture an aow, it turns your pistol into a violation of the national firearms act. That is unless your pistol is large enough then it just becomes an "other"

The closest to NY I would get too would be PA with my Class III stuff.I will ponder the offer. Honestly, I am wary of some folks on this site and there are some I have disdain and dislike of. That is the main reason I am reticent to send my Class III stuff from CT and GA to NY for some fun shooting; and why I have stopped inviting people out to my range from this forum. While it is true that none of us will ever get along with everyone in the world; I certainly do not want to invite trouble into my life. I hope you understand, even if you disagree with my apparent paranoia on the subject.
