The reality is that a pump action shotgun isn't an assault weapon under the intent of the SAFE Act and the former 1994 AWB ban in any shape or form. What this guy wants to built absolutely is except for this definition gap. I still think it's technically legal, but they quite possibly would take action on the short stockless AR whereas they're not going to dwell on the shockwave.

You are probably right. That was my argument before that although legal, they can declare it a pistol with a grip anyway.

I definitely will. But so you know Franklin Armory is hesitant to ship to NYS. When asked why, they simply say they are concerned with PL 265 and refuse further explanation.

Well whether its semi or pump has nothing to do with it in this case. Why the police letter even points out the action in question is non-sequitur
The issue isn't necessarily with the law, its the cop thats going to in some scenario see your gun and arrest you for it. The ADA is going to jam you up and the DA is going to do one of two things: 1. try and prosecute you under a safe act violation taking the risk that if the prosecution fails they inadvertently create precedence for legality or 2. not pursue it knowing the risk from 1 just to make sure they don't do that.

Because pump actions can’t be assault weapons no matter what features they have. Not the case with semi-autos which are highly restricted.
Well Jerrys located in NY state is selling these so they must be legal?? yes no ?? Iam confused. Can I build my own?

I think you should read this entire thread and then decide on your own if it's worth the risk. Whether it isn't labeled as a pistol by the company, it doesn't mean a NY law enforcement officer will not charge you as having a pistol with a forward grip installed. It resembles exactly to the letter what NY classifies as an Assault Weapon in a pistol configuration.

What if you made an AR15 style lower with a 410 shotgun upper, with a brace, a front vertical grip, and overall length of 26.5 inches. Can’t be a pistol because it is smooth bore, can’t be a rifle because it is smooth bore, and can’t be a shot gun because it was not made with a stock or designed to be shot from shoulder.

And that is why Suffolk PD issued a letter saying that the shockwave wasn't a shotgun and was therefore legal. By every letter of the law, this is legal. Because NY doesn't define a pistol(thereby falling back to federal defition), and the NY definition of "firearm" says it must be a pistol/rifle/shotgun under 26", this doesn't fit NY's definition of a firearm and falls back to the federal definitions as well. Good to go by letter of the law. I agree with Willjr75 however, there's no way this is going to be allowed to stand if these start becoming popular. Cuomo and his entirely democrat controlled NY government will amend the Penal code 265 faster than it took to write this post.
I thought it was to good to be true. After reading the entire thread I think its kinda risky. My AR's have thordsen stocks. and no other dreadful features. They look weird but what you going to do. I cant by a fixed mag version. just wont do it.
