From NY Penal Law 265:

22. "Assault weapon" means
(a) a semiautomatic rifle that has an ability to accept a detachable
magazine and has at least one of the following characteristics:
(i) a folding or telescoping stock;
(ii) a pistol grip that protrudes conspicuously beneath the action of
the weapon;
(iii) a thumbhole stock;
(iv) a second handgrip or a protruding grip that can be held by the
non-trigger hand;
(v) a bayonet mount;
(vi) a flash suppressor, muzzle break, muzzle compensator, or threaded
barrel designed to accommodate a flash suppressor, muzzle break, or
muzzle compensator;
(vii) a grenade launcher; or
(b) a semiautomatic shotgun that has at least one of the following
characteristics:
(i) a folding or telescoping stock;
(ii) a thumbhole stock;
(iii) a second handgrip or a protruding grip that can be held by the
non-trigger hand;
(iv) a fixed magazine capacity in excess of seven rounds;
(v) an ability to accept a detachable magazine; or
(c) a semiautomatic pistol that has an ability to accept a detachable
magazine and has at least one of the following characteristics:
(i) a folding or telescoping stock;
(ii) a thumbhole stock;
(iii) a second handgrip or a protruding grip that can be held by the
non-trigger hand;
(iv) capacity to accept an ammunition magazine that attaches to the
pistol outside of the pistol grip;
(v) a threaded barrel capable of accepting a barrel extender, flash
suppressor, forward handgrip, or silencer;
(vi) a shroud that is attached to, or partially or completely
encircles, the barrel and that permits the shooter to hold the firearm
with the non-trigger hand without being burned;
(vii) a manufactured weight of fifty ounces or more when the pistol is
unloaded; or
(viii) a semiautomatic version of an automatic rifle, shotgun or
firearm;
(d) a revolving cylinder shotgun;
(e) a semiautomatic rifle, a semiautomatic shotgun or a semiautomatic
pistol or weapon defined in subparagraph (v) of paragraph (e) of
subdivision twenty-two of section 265.00 of this chapter as added by
chapter one hundred eighty-nine of the laws of two thousand and
otherwise lawfully possessed pursuant to such chapter of the laws of two
thousand prior to September fourteenth, nineteen hundred ninety-four;
(f) a semiautomatic rifle, a semiautomatic shotgun or a semiautomatic
pistol or weapon defined in paragraph (a), (b) or (c) of this
subdivision, possessed prior to the date of enactment of the chapter of
the laws of two thousand thirteen which added this paragraph;
(g) provided, however, that such term does not include:
(i) any rifle, shotgun or pistol that (A) is manually operated by
bolt, pump, lever or slide action; (B) has been rendered permanently
inoperable; or (C) is an antique firearm as defined in 18 U.S.C.
921(a)(16);
(ii) a semiautomatic rifle that cannot accept a detachable magazine
that holds more than five rounds of ammunition;

Bolded the relevant portion at the end. If you remove the magazine catch from a semi-automatic rifle, the rifle would be incapable of accepting any magazines, much less magazines which hold over five rounds of ammunition. Thoughts?

I'm confused by your statements. If you take off a magazine catch on a semi automatic rifle, it's not "incapable" of accepting any magazines". The magazine catch only secures the magazine in place until it's depressed. You can grab/cup onto any magazine yourself with a secondary handhold, insert it, and fire in semi automatic all day. It's less convenient and impractical, but still accepts any detachable magazine.

I use those for my compliant mini gun. I just put pillows over the barrels instead of silencers. Pillows have their own threads, so the barrel doesn't have to.

Edit: just realized I got a bit thread-crappy. Sorry.

that can or may send a message in 1200 FPS or Foot lbs give or take; is the Assault Weapon ..

This topic has been beaten a lot in the past 5 years which is why the OP is having a hard time getting traction.

To be certain though, yes, in most cases a rifle can be made safe act compliant by locking the magazine with a pin or something. This is how stores are still selling AR-15 pattern rifles with pistol grips and fore grips, etc.

Many people here expect an update to NY SAFE with a 2.0.

I understand the fixed magazine approach. But the exemption I highlighted states that you can have a rifle with a detachable magazine + all features, as long as that rifle can not accept a magazine over 5 rounds of ammunition. I never heard of anybody bringing this up or creating a compliance device based on this concept.

That sounds about right. I wonder if a magwell that prevents inserting any magazines would fall under the letter of the law.

I bought an M1A scout in the beginning of the year. My LGS received the action and barrel as required. They would not release the threaded barrel to me as is. I stated that I was going to remove the mag release and bond the mag to the stock. Said I was going to use epoxy and was told it's not considered permanent. I said then I'll use the wood stock and weld the mag to the metal liner.
He said they talked to the SP about making the rifle compliant in this manner and asked what was legal. Their response was that they would make the arrest and let the courts decide. Now I have a modified muzzle and detachable mag.

How about LRB faux muzzle brake ($129), castle nut set screw hole tig-welded just enough so that set screw cannot be removed or tampered with (no need to weld castle nut to sight). Now it can have a removable mag.

No accessible muzzle threads, no muzzle brake, no flash suppressor, no bayonet lug, no protruding hand grip, sounds pretty "safe" to me.

To OP's point. You can install a sled into mag well with non-functioning mag catch that will hold the sled in place. End result is a rifle with single round only loading capability and with no modifications to the lower receiver.
Sled is a commonly used device by competitive shooters to load AR's in single loading stages of highpower competition. It has been around for about 16 years. It's not even considered a magazine since it doesn't hold a single round of ammunition. It only makes loading AR with a single round easier and jam-proof.

The advantage of what I suggest is that it doesn't appear like you are skirting the law. You will probably get NYS Model Citizen award for owning a single shot rifle. When you move or travel out of state you can install a normal mag. catch and have a normal rifle. You also end up owning a sled which is a practical device for serious AR shooters.
