It depends on the context of the situation. In this situation, solely on stealing the gun, and not the assault, No. There was failed attempt to steal, but no other threat. (until the screwdriver came out). Once he had the gun in his hand , fair game . loaded or not ,its not for the people around him to determine that. He could have slapped a mag in without someone seeing it. the owner could have had another loaded gun , Its assumed lock and loaded during a commission of a crime.

In most cases it would not be a felony to take a pistol. Just a simple larceny. You can see how this defense is already off of the rails and we have only just begun. It sucks, but absent an aggravating action being taken by the thief, you don't stand a chance with your defense. The law is clear. Larceny (even felony level) = NO D.F. The grand jury will be given instructions and informed of the fact that no D.F. may be used per the law. Remember, for a good shoot it must check all 3 boxes. Lawful, reasonable, necessary. You likely don't even check 1 box leet alone all 3. It would not be a good day. You'd be wishing you had just walked away in a hurry.

He wasnt shot during a "larceny", he was shot after he stabbed a cop in the neck with a screwdriver.As to the "larceny", if he entered the premises without permission it is burglary.
You would be right only under a specific condition. In NY if you trespass with intent to commit any other crime it is indeed burglary, a felony. However this appeared to be a public facility so in order for this case to be made he would have had to have been previously trespassed from the property. You would want written documentation to prove this. Without a previous trespass warning, he did not enter or remain unlawfully, as the law requires.

If it is, as you say, a "public facility" it was being used by a private school to give a class.If he wasnt registered for that class he had no permission to be there.He attempted to steal a gun while on a premises he had no right to be in.Burglary.According to your reasoning a burglary cant be commited until after a tresspass was issued?If he wasnt shot and killed he would be charged with burglary.

My reasoning is not involved. Only the letter of the law. It’s open to the public. It’s a gun range or retail facility. Anyone can enter while open for business unless they’ve been trespassed previously. Maybe if there were signs posted that anyone entering that was not registered for the class would be trespassing you

That’s like saying if you go to the grocery store but don’t buy anything you have entered unlawful. A swing and a miss.

Lets assume you are right and that its a private range,although I saw nothing that indicates that,but we all know you jailhouse lawyers are always right.The room the class was being held in is not open to the public,it is being used and likely rented by the group giving the class and open only to people involved,now if I was the RO and the people held him til we arrived and they tell me he had no permission to be in the room and he tried to steal a pistol he would be charged with burglary.From reading your posts in the past I know, right or wrong, you want the last word,so have at it,I am done.Talking to you is like talking to....a jailhouse lawyer.By the way, hows that open carry in NY and riding around with a loaded shotgun going?I am guessing you never followed thru, just talking out your ass as usual.
If it’s a retail business and open for business anyone can walk in. That’s a fact. Unless he went into a restricted area and violated posted signed that said he was not allowed to enter then you don’t have a case. He didn’t enter some guys house. This is a business that is located in a plaza or strip mall. The sign says open and the doors are unlocked and the lights are on. Remove your personal feelings and read and law and apply it.
Open carried yesterday including when I went out for a sit down lunch at an area restaurant, thanks for asking. Not sure why you’re worried about what I’m doing though. Weird.
