There are laws pertaining to the copying of classified information. If he photocopied any of these Top Secret documents since leaving office he has broken yet another law.

As to the actual nature of the material in the photograph staged by the DOJ for media use, many of the documents you see in the picture are transcripts from the 2018 House Intelligence Committee (HPSCI) investigation and witness testimony. I'm sure there is little chance a jury in Washington DC would convict Donald Trump.
He could have when he was president. He isn't now. But in any case the DOJ is more interested in the fact that irrespective of whether these were or weren't classified it was still illegal for him to have these documents in his possession. That's why his claims that he had a standing order, although devoid of evidence, are not the real meat of this case.
