Only way he could have been charged with a crime if this was NY is if he lacked a pistol permit, like in the case of the homeowner who used his deceased father’s gun. But not for murder, even by NY standards this shooting is 100% justified end of story.

On this issue, I'm not surprised.
No tin foil here but I'd not be surprised to learn of some level of manipulation to be sure that any confusion or misunderstanding reagarding self defense/lethal force is never resolved. Better to be uninformed and dead/injured for certain interests.
It comes from people just not getting educated or even reading the laws, mix in the narrative of how bad New York is for gun ownership so gun shop chatter turns into well it's new york I must not be able to use a gun to protect myself.
Add that to the typical @beebee who probably heard the term castle doctrine on the NY Post or briebert and stand your ground on Fox or CNN, quickly scanned the NY law didnt see those words but read "duty to retreat" and turns that into you cant defend yourself and New York law says you have to run away from everything always

Says he has read the law 1 million times, but also thinks that if someone is committing a robbery and using deadly physical force, the victim cannot use a gun to defend themselves.
Also is dumb enough to think that NY is the only state that a person who uses deadly physical force?(Even justifiable) they would also be risking civil lawsuit, and not even realize that is how it goes in literally all 50 states.

The self defense laws in NY are clear as mud, and ARE routinely used against those that use deadly force by overzealous DA's and Prosecuting Attorneys.
If you are in a life or death struggle with a perp in your home, and in the melee' get a shot off that happens to hit him in the back as he lunges at you, how the hell do you prove he wasn't trying to run away??.. That sort of thing will be used against someone that has rightly defended himself with lethal force.. Think what you want, but in my opinion many jurisdictions in this state will side with the criminal in cases where lethal force us used... bob
