It is very valuable for me. I'm all for changing the language to be more inclusive but not to the point of sinking the bill. If this is passed it can be ammended, expanded or replaced in the future.

The only thing this gives us is the ability to carry in other states and for others to carry in ours. That's it.

That's what I've been arguing. The bill is poorly written, and the anti's will do their best to punch holes in it while throwing people in jail. Better than nothing, but still a long way from what it would need to be.

And i wonder what states are going to deem a restricted NY license an no go. Can a federal law have the power to mandate shale issue? seems like they are putting the cart before the horse with this.

Article says I would be covered because any carry permit from any state will be good in every state. I don't see this being true how the bill reads. It also seems like if your state doesn't require a permit your still covered or am i reading that wrong?

Hear me out. The text of the bill says...

Notwithstanding any provision of the law of any State or political subdivision thereof (except as provided in subsection (b)) and subject only to the requirements of this section, a person who is not prohibited by Federal law from possessing, transporting, shipping, or receiving a firearm, who is carrying a valid identification document containing a photograph of the person, and who is carrying a valid license or permit which is issued pursuant to the law of..... a .......State and which permits the person to carry a concealed firearm..... or......is entitled to carry a concealed firearm in the State in which the person resides, may possess or carry a concealed handgun (other than a machinegun or destructive device) that has been shipped or transported in interstate or foreign commerce, in any State that— (1) has a statute under which residents of the State may apply for a license or permit to carry a concealed firearm; or (2) does not prohibit the carrying of concealed firearms by residents of the State for lawful purposes.

The key words are A and OR.

So if you are not prohibited from Federal Law from owning, transporting..... Check. We are good there.

And you have a picture ID issued by a state.... Check. We are good there.

And you are carrying a license or permit issued be A state that permits you to carry a firearm..... Check. We are good there with an out of state license.

We qualify under what's written in the text of the bill. The OR IS for people who reside in Constitutional Carry states that don't issue permits.

I still have a concern that the anti's will try to prevent people from carrying in places like NYC, and a shitstorm will hit if it passes and people try carrying there on their out of state permits. I can see NYS trying to claim that NYC is some "special place, zone, etc." much like a courthouse or somewhere else, and passing some BS laws to prohibit people using other states permits from carrying there.

And then, of course, the issue will get tied up in knots and the courts for years to come.

I almost think they need to either simplify it to say that everybody can carry everywhere (constitutional carry in essence, which this bill is not), or else they need to include a provision mandating that carry will be permitted throughout the ENTIRETY of the state, with no special areas or exclusion zones allowed.

But therein comes the problem. This proposed bill says that you can carry in other states subject to that states local laws (like no hollow point bullets in NJ, and no magazines holding more than 10 rounds in NY for example). So, now the carrier from NC with a 15 round magazine has a problem in NY.

I just see NY and others like NJ, MD, and CA claiming that their laws (existing or newly written ones) prohibit concealed carry by other states carriers in places like NYC (and other major cities too).

It will be a battle and a half.

Anti's will try all sorts of things to prevent the intent of this. I could see Cuomo trying to revoke ALL concealed carry permits in NY. Regardless, this is a move in the right direction regardless of its lack of perfection. For those of us who travel out of state and have a carry permit, it makes life a lot easier (and more secure.) No more need for an out of state permit and trying to figure out how you have to weave through states to get to Florida on vacation. The restoration of our rights needs to start somewhere. I am really tired of losing all the time and never seeing things go in our favor.

And any movement forward is movement in the right direction! No need to squabble over specifics because once enacted, it's going to get bounced around, chewed up, spit on, piled on, amended, adjusted and more! So what's to worry? It's not going to be perfect out of the gate, it's not going to encompass all that is wanted by everyone...

I'll take any 2A friendly legislation in the first months as a great sign and a shot across the bow of the Liberal Progressive Goodship Lollipop, oh heavens how they'll all tremble!

Honestly, a Federal Law requiring Strict Scrutiny be applied to the Bill of Rights in its entirety would be the only catch all win-win for us. Anything else is scaps off the table, but considering the open and outright hostility towards gun rights over the last 8 years and professions from the attempted Clinton takeover... I welcome any movement forward, no matter if it's an inch at a time!

I agree. Realistically what they can do is work with the wording of the bill and pass laws where no gun signs become the force of law like in Texas.

Every restaurant, hotel, store, ect would have these signs rendering carrying almost useless.

The bill also says that the magazine and ammunition in it is part of the definition of firearm and is protected when carrying according to the provisions of this bill so if like to see how HP's fly in NJ.

Actucally, since a pistol version in free states exists of practically any rifle platform, I was referring to the inclusion in the bill of the language regarding magazines. To avoid confusion, I will henceforth refer to the 30...30 caliber magazine clip that can be emptied in half a second.

Could the State mandate 10 round max mags and no travel to NY $hitty as like years ago with drivers license..NY was one of the last to allow right on red. Other States and Canada had it but a right on red got someone a ticket ...if caught

This is where I think some of the shit will start from the anti's. Also, I can see the anti's in CA (and MA?) flipping out over people carrying guns in their state that are not allowed to be sold there. Just like here in NY, - we can't buy a regular old Desert Eagle .50, but someone from NC could bring one here during their travels.

Obviously but that wouldn't stop him from trying. Remember, with all the positive measures he thinks he took to protect NY and the country from guns, he will not sit idol and let people come into and out of the state without doing everything to try and stop it.
