It really isn't where I'm going to purchase that had this happen It's a backround check that every FFL has to submit.

It is total BS. My FFL is going to do the transfer when the 30 days expire on the most recent check unless we hear something before then but I doubt it.

I think it's because I don't have a particularly common name. I also put in my Social #. Are you doing that? It can help prevent cases of mistaken identity, especially for those with common names.

Yes I did use my SS#. My first purchase also went into delay status but the wait was one day and I was approved.

Exactly my status was delayed for a purchase on Aug 23 and remains open as we speak. After 30 days past we resubmitted another check on Sept 23 , I also filed an appeal with NICS on the Aug 23 check. Haven't gotten a response from NICS about the appeal. The Sept 23 check same deal. It went to delay and remains open. After 30 days elapse from this recent check my FFL is going to make the transfer unless we hear sooner.

If you're persistently getting delayed and plan to continue building an arsenal you might want to consider a UPIN.
I'm guessing there is someone out there with a questionable record that has the same or similar name as you. That's what it usually is.

I'm thinking the same but the first delay went a lot more faster to approve then this one. It also has my FFL baffled being it taking this long with no answer. It's just left sitting on open status.

I'm thinking of applying for a UPIN. It won't prevent the delays from happening but the results would happen quicker.

I've only ever been delayed once, and it was picking up my first handgun on a Friday. Had my range trip all planned out forSaturday, did my county clerk paperwork on lunch hour, went back to FFL after work to pick it up.... DELAYED!! Talk about major cock block.

The ATF stops looking after 3 days.
If it doesn't become a proceed in the first 3 days it never will.
In the rest of the country, if it doesn't become a deny in the 3 days, then it becomes an implicit proceed and they can continue. If you don't pick it up in 30 days, then the original check expires and a new one must be run.
NY is asshole. They require you to wait 30 days for a proceed that the ATF will never issue. What's worse, is that after the NY 30 days have passed, then the feds say the check is no longer valid, so you will have to run a new one, which can possibly be delayed again.
Did I mention NY is asshole....

Yes you have to run a new one but if that is put on hold I believe after the 3 days as per feds you can proceed, you have already met the NY requirement. It says nothing about waiting another 30 days or that it has expired just that you have to wait 30 days. thirty calendar days shall have elapsed since the date the seller or transferor contacted NICS. you already contacted them the first time says nothing about a second time for the same transfer
§ 400.20 Waiting period in connection with the sale or transfer of a rifle or shotgun. When a national instant criminal background check is required pursuant to state or federal law to be conducted through the National Instant Criminal Background Check System (NICS) or its successor in connection with the sale or transfer of a rifle or shotgun to any person, before delivering a rifle or shotgun to such person, either (a) NICS has issued a "proceed" response to the seller or transferor, or (b) thirty calendar days shall have elapsed since the date the seller or transferor contacted NICS to initiate a national instant criminal background check and NICS has not notified the seller or transferor that the transfer of the rifle or shotgun to such person should be denied. 40 § 3. Subdivision 1 of section 897 of the general.

Yes NY does suck!! We ran a new check on Sept 23 and still haven't heard. I haven't gotten a response from my appeal that I filed on the 23rd of Sept regarding the Aug 23rd check. I spoke with my FFL yesterday and when the recent one expires he's gonna do the transfer.
