30 days should easily be considered an infringement under a " instant background check " in any court room.
The magizine capacity 7- 10 argument was also ruled " arbitrary" by the courts. 7 was to little , 10 is constitutional.. We'll see what number the courts decide is good for us..

If it was just a 30 day waiting period, this only has to do with delays they will argue that they are rare and in the interest of public safety
Of course its not a golden key, we are talking about government.
I know a couple people who have been denied with a UPIN.
But I know a whole lot more who have had issues with delays for years but clear sailing sinse getting a UPIN.
My FFL says hes had dozens of wrongful denials but only 1 wrongful UPIN denial sinse 1986.

I was under the impression that the FBI does not retain the information submitted to them by an FFL during a NICS check.
Is the info of previous approved NICS checks in effect a handgun registry kept by the FBI?
If one applies for a UPIN, does the FBI begin retaining information about present and purchases made after one applies for a UPIN, or, can the FBI look backwards in time and see previous, approved purchases?

I dont dispute this but, the way UPIN is (supposed to) work is like a bonus social security number that identifies you specifically as you when they run the background check itself (i.e. no false positives on prohibited persons with the same name).
So basically yeah it ties back to your whole secret file in the basement of Ft. Meade.
I'm lucky (to date)- I have a... unique... surname. I've never had a delay though they did have to rerun it one time (at the time of purchase) for some reason. Probably because they're still running Windows 95.

They are supposed to destroy all previous purchase info until you get a UPIN, then they keep it.
If thats actually what happens, I doubt it.

Evidently all queries against these lists, including the reason for the queries, ARE recorded and retained. All you have to do is filter the query records for NICS and bam, list of probable gun owners for the whole country.

I m clean and get delayed every time. I just went to an automatic 30 day wait, which sucks. Waiting on my uPIN to be processed (and waiting...and waiting...)

It is this. This is the truth of it. As a side note the 3 day wait is really the three business days of the the FFL or gun shop. Many people forget this even dealers.
So say my hours are three days a week(Tuesday, Thursday and Saturday). Someone comes in and gets delayed on a Tuesday and I am not getting an answer back form NICS. That means that they can't come back and get the gun until a week goes by. Most shops are open 5 or 6 days a week so that is why that get over looked but it is an interesting thing to point out. So according to the local ATF guy say you open your shop one day a month with this law it would now be impossible to do a transfer for a delayed person in this state.
It is a stretch here but my point is there could be an argument for this that it could screw with commerce not just some 2A case but it is a a really big stretch as I don't know a single FFL or shop that is open one day a month.

My last purchase was a Ruger LCP during a holiday weekend. It was denied and put on hold due to a large volume of people buying that weekend.
Going forward, I will buy in the middle of the week. If it’s put on hold, I will cancel the sale and go to another shop a few days later to purchase it again to circumvent the 30 day NYS waiting period rather than having to wait the 30 days.

But we all know that the FBI will not be doing any extra investigating on days 4-30 so why bother? Oh that's right it's for the children.
I know. And that's why I was saying hopefully someone gets delayed has to wait the 30 days and has the money to challange the law

And if you can do that, so can someone who's intent is murder. But if you're squeaky clean with a common name that gets you 100% delays like Csbdr, this method won't help you.

Background checks are unconstitutional. There weren’t any BGC’s in the 1980’s. Anyone intent on murder was shot during the act and if survived they were locked up in prison. If found to be a mental deficient before the act, they were locked up in a mental institution rather than being given drugs to remain amongst society.
