I think someone tried that in an NCIS episode....Wasn't there a movie or a TV show about this very concept a while back? I vaguely remember watching a show or movie that took place in modern times but there were two guys (both reenactors, but I think it was more Cowboys and Indians and not Civil War) where one (maybe both of the guys) did this to each other during a reeanactment and the cops couldn't pin it on anyone for the reasons you stated. Wish I remember what it was called. It was fiction, not a true crime story. I remember that.

It says an unloaded pistol.OK, so if muzzle loading is antique and therefore exempt by definition, where does it say I need a pistol permit to fire one? And even if I did need a permit, how are they supposed to add it without a serial number?
How crusty are your nipples?My "antique" is truly an antique, and is not currently in firing condition. All my nipples are crusted up. I'd have to buy a nipple wrench. I'd have to buy some new nipples. Then I'd have to install them.
I think I'll just leave my Colt in it's shadow box.

Nothing specific in the law address this issue but it is a combination of law and AG ruling.
First the law: NY PL265(15) "Loaded firearm" means any firearm loaded with ammunition or any firearm which is possessed by one who, at the same time, possesses a quantity of ammunition which may be used to discharge such firearm."
Second the AG Opinion, (a non -binding opinion,) OPINIONS OF THE STATE ATTORNEY GENERAL: "December 19, 1977 (informal No. 77- 00): Unloaded replica muzzle loading percussion pistols may be sold, purchased and possessed without a license. Simultaneous possession of these pistols and the necessary ammunition to discharge them requires a license. PL 265.00 (14) & (15)." Contact the Pistol Department for current rulings.
