Why do we blame merchants who are trying to protect their business from ruinous litigation over the shitty laws we have here in New York? Your problem is in Albany, not with primary arms.

What prosecution could they face for this? The OP is correct and selling those items here is not illegal. They could have you check a box saying you acknowledge this. By your standard every gun related item except revolvers, single shot, or bolt action guns should not be sold to us in nys. I just bought two sig 365’s and I can drive to pa tomorrow to buy illegal mags so what’s the difference?

That's their lawyers advising them on the best way to protect their business. They're based in Texas, why should they care about NY? Our issue is with Albany, not the merchants that (like us) cannot understand the idiotic laws here in NY.

I am so pissed off over this. PA was my go to shop. Another notch in Hochuls belt.
I buy from them too but they dont always have what I want and they are more expensive.

Companies are in the business to make money and stay in business. They want to make as much revenue as possible, continue to stay in business and They want to avoid risk. Our NY laws are worded like they came from a 3rd grader so I don't fault companies from being nervous about being in compliance. Let's face it out AG is a litigious vengeful power hungry nut and she wouldn't hesitate to try and sue/prosecute an out of state company in free America for daring to defy whorcul. 100% it's the lawyers advising companies "you need to protect yourself there is too much risk and uncertainty to do business in that state".
Reverse the situation, you own a business, a whacko state like California has customers that want your products. California has some batshit crazy bad laws and nothing makes sense. You want to sell your products in California but your company lawyers are saying that in doing so you're opening up the company to exposure and risk which could get the company tied up in major litigation. You regrettably dont sell your products to California, it's Sacramentos fault.

It's all about thei risk of losing. Lawyers and insurance companies know this. Both are very expensive so it's very easy for businesses to abide by the 'cease and decist' order that was imposed. Business will surely pick up in the next couple of weeks, probably breaking sales records (once again).

So what's the end game then for PA? They say eff the in process lawsuit (yes, thats for 80%, but never underestimate the power of NYAG to continue to bring suits) and continue to sell to NY. They spend $millions to define defend themselves and win. Yay! Damn the man! But now they're out of business. Who's the real winner? The risk vs. reward is not on their side....
I don't blame ANYONE that doesn't want to do business here. The fault lies squarely with Albany and the people of NY that continue to send clueless liberal fucktards back there year after year.

Sorry for this hassle!!!! This is an unintended offshoot of the what is referenced above, your esteem Attorney General of NY suing 10 gun companies, including PA. I will have a way for customers to confirm they understand the law so we can start shipping these items again by the end of day tomorrow.

They are suing for Ghost Guns,,, which is their name for a 80% lowers, with no serial number. They arent going after anyone for barrels, upper receivers, grips, muzzle devices or anything else.
So what you said above, I truly dont understand. Did you all change your minds on these parts or come up with a way to protect yourself from the shit bags in Albany?

While I can understand, but disagree with their perception of a legal position, this only serves to set legal precedent. Once you acknowledge that any part of a firearm manufactured or parts sold by your company maybe considered illegal in whatever state; is it really a stretch then to say that said company selling a complete firearm knew that it could be used to break the law or used in a homicide, and then ask as to why they sold it in the first place with this knowledge? This is whats known as the proverbial slippery slope. This type of compliance only complicates future legal defenses which is certainly coming their way. The burden of legality and intent is on the consumer in these situations. The firearm and ammo manufactures are just boxing themselves in for a legal loss and huge back breaking law suits. Alex Jones.....1 trillion dollars.
