Recert repercussions? (Pistol permit)

I work with such a guy and he has faced zero repercussions as well as his wife.

Have they added new pistols since then? Curious if the lack of recertification would come up when a new amendment goes before a judge.

Many counties the judge is not involved after issuance. Unless a big message pops up on a screen the clerk just processes it as normal. Since the State and the County really do not seem to communicate that much it would not surprise me that message does not make it.

There is no conduit between NYSP and County when it isn't done. County is the issue authority, State created the requirement with no enforcement resourcing or authority....until you do something that makes them look.

Because the authority for permits rest at County level. The requirement is an artificial insert by the State not within their authority.

Picked up a used snub Model 10 the other day, FFL said a judge in Ulster County is reviewing your recertification history during any amendment processing and if you have not recertified on states schedule he will pull your license

Which schedule? State is intentionally trying to entrap people by changing the law.

Update on this, a friend, whose brother in law was transferring a pistol from his sister located in orange county to his ulster county permit was called by the sheriff's office and told his pistol permit was revoked by a female ulster county Judge. The judge had reviewed his recertification history and found that it a elapsed for a couple of months before he updated it. He had turn in his own pistol as a result. He's awaiting a hearing from the judge to determine what she is going to do.

What's sad is for my PA permit I get a letter well in advance of the 5 year expiration. When every other license is due for renewal in NY you get notification in writing. Can you smell the infringement and entrapment intent here?

Even they ATF sends you a reminder WITH the PREFILLED form to update your FFL.

Sounds like he needs a good lawyer. The NYSP is the proponent of the three year background check; because the legislature passed a requirement with no resourcing. He submitted and was given a validation by them; which he can print from their website. Although there may have been a lapse, they did not identify nor de-validate his background check; which could have suspended his permit. They validated it. The three year requirement has no clause discussing grace periods or penalties; compliance was met. Very subjective of this judge I must say. This judge doing overtime to check dots and lines must have nothing going on in their county. Must be nice to be in such a crime free and safe quiet area.

It’s nice to live in a county who supports law abiding citizens attempting to do the right thing, within a structure developed to not be understood even by those assigned the task of enforcing it. But maybe we could learn from this judge to clear our plate of real crime. Who knows.
