Funny I read that there needs to be no acceptance for the pardon to be valid. The two death row inmates don’t want to accept it because they think it will be seen as an admission of guilt is what I read. No expert though and don’t remember what source it was but I think it was associated press.

You are correct that a pardon need not be accepted, and is not considered an admission of guilt. The two guys on death row are fighting the pardons in court. They would not need to do so if they could simply refuse to accept them.

Dont remember where I saw the other view, but I went looking and it seems a lot of facets of the pardon rules and procedures are the result of court decisions on challenges over the years. The act of granting a preemptive pardon, Nixons is the only one I found, have never been challenged in court as yet.

Near the end of President Trump's first term, all of the legal scholars interpreted Burdick v. United States, 236 U.S. 79 to mean that accepting a pardon is an admission of guilt. Now that the pardons have been issued by Biden, the interpretation is not clear.
