Damn Rino. New Hampshire Secretary of State David Scanlan (R) is consulting with the state attorney general to invoke the U.S. Constitution’s Fourteenth Amendment to keep Trump off the ballot.
“The bottom line here is that President Trump both engaged in an insurrection and also gave aid and comfort to other individuals who were engaging in such actions, within the clear meaning of those terms as defined in Section Three of the 14th Amendment,” Caplan said. “Assuming that the public record to date is accurate, and we have no evidence to the contrary, Trump is no longer eligible to seek the office of the President of the United States, or of any other state of the Union.”

A House Democrat says the 14th Amendment bars Trump from becoming president again, if elected. But law experts say there are three key points to answer first.
Does the insurrection clause in the 14th Amendment apply to Donald Trump?
Section 3 of the 14th Amendment dates back to the Civil War. The intention was to prevent the president from allowing former leaders of the Confederacy, who engaged in rebellion against the U.S., from holding office after they were granted presidential pardons.
“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.”
In plain language, this generally means that someone who “engaged in insurrection or rebellion” can’t hold certain public offices.
But several legal experts argue this probably doesn’t apply to Trump. They point to three eligibility questions:
- Did Trump’s conduct amount to engaging in an insurrection?
- Who does this apply to in government?
- Is the president considered “an officer of the United States”?
“At issue in the lawsuit would be whether his actions qualified as engaging in insurrection or rebellion or giving aid or comfort to enemies of the Constitution. Because we have no precedent for how a court would approach that issue, one would expect that the evidence gathered by the January 6th Committee and by the Justice Department would be aired in court with judges deciding whether it is sufficient to invoke the Fourteenth Amendment,” Peck said.
Doron Kalir, clinical professor of law at Cleveland-Marshall College of Law, told VERIFY as presently written and as he interprets it, the highest office this section would apply to is a senator. Kalir said the section says the rules apply to people in the following positions:

A challenge has been filed in a federal court seeking a declaratory relief on the eligibility of President Donald Trump to run in the 2024 Presidential Election.The petitioner cites Section 3 of the 14th Amendment of the U.S. Constitution, which disqualifies individuals involved in “insurrections” against the government from running for federal office.
George Washington University law professor Jonathan Turley called the efforts by the Democrats and the RINOs to keep Trump off the ballot as “most dangerous constitutional theory.”
“I think this is the single most dangerous constitutional theory I have seen pop up in decades,” Turley said during interview with Laura Ingraham.
In a recent social media post, Charlie Kirk, the Founder and CEO of Turning Point USA, weighed in on the ongoing debate over former President Donald Trump’s eligibility to run for office in 2024. He suggested a countermove if Trump is removed from 2024 ballot based on 14th Amendment.
“”Legal scholars” are arguing that local elected officials at both the state and county level have the power to unilaterally remove Trump from the ballot on the basis of the 14th Amendment—WITHOUT even so much as a conviction,” Kirk wrote.

It *is* a trial in the senate, presided over by the chief justice of SCOTUS.
I had never considered it before, but it seems likely that double jeopardy would have attached.
The constitution simply says you shall not be put twice in jeopardy. So, if he was in jeopardy during the impeachment then that's the government's one and done.
Although I don't believe the charges in the impeachment overlap with any of the current charges (federal vs state), so that would make it irrelevant.
