These are good points. I have tried to maintain optimism on this bill to this point, but that optimism is dependent on every one of our party members staying true to its principles. If any republican flops like they did yesterday, I would agree that our chances of getting 60 votes is slim to none (though more than 50 would still be very possible). I say there is still a path to 60 if all republicans/independents vote in favor, and just a handful of democrats cross the aisle. Unlikely perhaps, but certain not impossible or "DOA" like some are suggesting.

I dont travel much, but i really need to carry in nyc. Next contract is in a very, very bad neighborhood (and worse if you look like me).
Maybe republicans can just use the nuke option??

The CFPB was essentially created to work as a legal money laundering operation for progressive causes by fining financial institutions for conduct the CFPB finds in violation of their unilateral and arbitrary rules and regulations. The CFPB then use the proceeds from the fines to fund progressive organizations and causes. That’s the underlying reason why the Democrats are fraught with anxiety right now.
Elizabeth Warren set up the bureau to operate above any oversight. Additionally, the bureau was placed under spending authority of the federal reserve. The CFPB gets its operating budget from the Federal Reserve, not from congress. Again, this was set-up to keep congress from defunding the agency as a way to remove it.
Everything about the way the CFPB was structured was done to avoid any oversight. Hence, a DC circuit court finding the agency held too much power, and deemed the Directors unchecked position unconstitutional.
Mick Mulvaney is now in a position to look at the books, look at the prior records within the bureau, and expose the political agenda within it to the larger public. That is sending the progressives bananas.

Have you read the text of the bill? Would it actually cover us in NYC, or does it just apply to non-residents?

I have read it, and I saw nothing that would preclude someone from carrying in New York City. Now that's not to say that new york state or New York City wont immediately look to get an injunction from the courts , while they sue the fed gov, but I don't think that would go anywhere.
If this bill actually became a law I think there would be plenty of New York State residents that would start carrying throughout the state regardless of any anything.

I think it will play out like this ... out of state guy drives in NYC and get pulled over or whatever ..
sorry that CCW from the other states is not allowed here in NYC .. .. clink goes the cuffs ..
then this part of the bill kicks in .. so they bleed you dry and hope you can get some of your $$$$ back ..
“(c)(1) A person who carries or possesses a concealed handgun in accordance with subsections (a) and (b) may not be arrested or otherwise detained for violation of any law or any rule or regulation of a State or any political subdivision thereof related to the possession, transportation, or carrying of firearms unless there is probable cause to believe that the person is doing so in a manner not provided for by this section. Presentation of facially valid documents as specified in subsection (a) is prima facie evidence that the individual has a license or permit as required by this section.
“(2) When a person asserts this section as a defense in a criminal proceeding, the prosecution shall bear the burden of proving, beyond a reasonable doubt, that the conduct of the person did not satisfy the conditions set forth in subsections (a) and (b).
“(3) When a person successfully asserts this section as a defense in a criminal proceeding, the court shall award the prevailing defendant a reasonable attorney’s fee.
notice just attorney fee ... nothing for being jammed up , nothing for lost work ...
“(d)(1) A person who is deprived of any right, privilege, or immunity secured by this section, under color of any statute, ordinance, regulation, custom, or usage of any State or any political subdivision thereof, may bring an action in any appropriate court against any other person, including a State or political subdivision thereof, who causes the person to be subject to the deprivation, for damages or other appropriate relief.

IF this were to pass in its’ current form, I will be printing up a “rub it in your face t shirt” for my upcoming National Reciprocity tour, and posing for pics in all of the places I can think of, and then posting them on social media.
The front of the shirt will probably say something like:
OMFG! You’ve just been in the presence of a lawful gun owner carrying a concealed firearm under National Reciprocity,- and NO ONE was SHOT or DIED as a result!!! Wow!!! Who knew it could happen?
and the back side would list the states and cities on the tour with checked boxes.
I’m pretty sure HR 38 was modified to include lands managed by the National Park Service. I wonder,- is the Statue of Liberty part of that? Seems like a perfect place to start my tour, followed by the top of the Empire State Building; Freedom Tower, 1 Police Plaza, Time Square, Central Park, Wall Street, NYSE, outside a Big Bird news conference, a Subway car ride,... and many, many more!

Does this mean the arresting officers, and prosecutor no longer have qualified immunity if they attempt to prosecute someone for this ?
That would make a *huge* difference if you could sue them personally. How many NYPD officers and DAs want to risk losing their house and just to harass someone for exercising their rights ?

Here's the deal! On its own merits the bill won't make it out of the Senate! And if the Republican Congress wants it to pass, they will attach it to strings that can't be ignored, like the budget or the debt ceiling, etc.! If they are just playing politics, ie, geeeee, we "TRIED", then they will allow it to float and flounder while taking pictures and saying how they support citizens Rights, blah, blah, blah...
It really is that simple. Just shove it down their throats! Attach it to something that can't be ignored and not passed and it's done! If Trump wants to stand on a single thing that will guarantee his re-election, this would be it, along with the Wall! Lol... Anything else is just gravy.
