The threat is in the eye of the beholder. The guy thought there was an impending threat to serious bodily harm. I will not second guess what was in his mind.
By the way, in your scenario, my wife was assaulted, in this real life situation, the guy did nothing but throw words. Words are harmless. He was attacked, regardless of what the shooter may or may not have said.
What he did was line up his sights and then take the shot. While he was lining up his sights, the attacker was nowhere near him.
The scenario I gave you is very similar to what happened. But since you didn't like the throwing of the drink in the face, scratch that and just keep it at words. From your own words you always comment on what you would do when these things come up. Does that guy have a justifiable reason to fear for his life and kill you?
