PS .. BTW .. the 2nd Protects the First
Yes I did know that but I was skeptical the SC would do that but now it seems like they maybe waiting to pounce on it.Thank you for explaining this. This is much more clear now. And also shows how foul the 2nd Circuit is. It’s amazing how everyone else around the country is benefiting from Bruen except us. We are still waiting for relief. My big question now is how long we must wait for the 2nd to respond and what “reasonable time” means.
Every one of the nine Justices has at one time been a lower court judge. They know exactly how long each and every phase of a case should take and what is an unreasonable delay.Thank you for explaining this. This is much more clear now. Yes and, as we've seen currently, while the S.C. makes a speedy decision using a GVR it opens the door to the lower court finding any means possible to further delay a verdict, up to and including remanding it back down to the district court that made the initial decision with a bullshit statement of "now do it based on Bruen" when the initial decision was already made using the Bruen criteria.Several cases were GVRd after the Bruen decision, the court simply says that 'the case is GVRd back to the XXX circuit court for a ruling in light of the XXXX decision.'
That can happen quickly.
True, but in the mean time, the anti-2A decision is vacated.Yes and, as we've seen currently, while the S.C. makes a speedy decision using a GVR it opens the door to the lower court finding any means possible to further delay a verdict, up to and including remanding it back down to the district court that made the initial decision with a bullshit statement of "now do it based on Bruen" when the initial decision was already made using the Bruen criteria.
A Right delayed is a Right denied.
I saw the Erie County DA speaking about it and it he said it doesn’t include the cases out of Buffalo. That to me means the Sinatra religious one is not included. I thought the other parts were combined but I can’t keep all this crap straight. It’s complicated at this point and the EC DA said he thinks they can enforce the CCIA. Honestly he didn’t even seem too sure himself and I got the impression he doesn’t really want to.I’m wondering if this also applies to the Sinatra cases. I saw NJ just combined all their cases into one.
It's not up to him to combine the cases or not. The recent note from SCOTUS indicated that they are looking at all the relevant cases.I saw the Erie County DA speaking about it and it he said it doesn’t include the cases out of Buffalo. "The New York law at issue in this application presents novel and serious questions under both the First and Second Amendments."he thinks they can enforce the CCIA...
Well there’s no stay at this point so technically the law is in play. I got the impression from his demeanor that he didn’t really want to and was questioning that."The New York law at issue in this application presents novel and serious questions under both the First and Second Amendments."
- Justice Samuel Alilto, with whom Justice Clarence Thomas joins. 11 January 2023
"I don't know when or even if I can exercise the Second Amendment, because FedGov hasn't told me if I'm allowed to yet, or in what time, place, or manner if I am. If the Supreme Court or some other enlightened branch of the government doesn't tell me what the Second Amendment really means, how can I know possibly decide for myself? If the Government didn't tell me what to do in every aspect of my life, I would truly be a lost soul.
Its not like there are documents from ancient times that made things like this explicit you know...
The very essence of Liberty is getting permission!"![]()
It took NYS 1 week to pass these unconstitutional laws, yet it is taking months to unravel them. So frustratingAntonyuk v. Nigrelli (2nd Circuit): Second Circuit says that four cases challenging New York's gun laws will be heard on 3/20.
doesn’t seem like there’s much hurry to me.
And now, take a look back at how many cases still haven`t even been looked at. That will even frustrate you more. Over 200yrs worth. Its all far from over. This is just the beginning. Some of us will even die of old age soon. I`m old, i`ll never live long enough to see the freedoms we use to have.It took NYS 1 week to pass these unconstitutional laws, yet it is taking months to unravel them. So frustrating
It'll take years, if ever.It took NYS 1 week to pass these unconstitutional laws, yet it is taking months to unravel them. So frustrating
No doubt about it Phazer, no doubt at all. They`ve had a 200+ year head start ahead of us while we continued being dumb an ignorant. Back in the 60`s, when the hippies were a problem coming up, i tried warning people, everybody just laughed at me. And if people think this will stop, jokes on all the ignorant ones. Wait until all those indoctrinated youth take over for the hippies. (and there is a hell of alot more of them than people think) When the indoctrinated youth take over congress, they will get rid of the US constitution. Think it can`t happen? Watch and see! Though i won`t be around to see it, some of you younger folk, just might. So, some will ask, why do i say this? Its simple. I`ve watched this country dieing of a slow death for many decades. You younger folks have a hell of alot worse fight to go thru coming up. If you love this country, MAN UP, and fight for it! If you don`t change the minds of the young, the young will change, you. And you are not going to like what THEIR plans are, at all. Only a fool does not see, what is coming. Look around at how the demographics have changed so fast. And its picking up speed. Ok, now where`s my freebie, you OWE me!!!!!It'll take years, if ever.
I agree. That’s 9-10 weeks from now. Not a hurry to me. They should get their thumbs out their asses.Antonyuk v. Nigrelli (2nd Circuit): Second Circuit says that four cases challenging New York's gun laws will be heard on 3/20.

You aint seen nothing yet. They will only hear these cases in 2 months. They they could do a number of things. Send them back down to the district courts or just take months to issue a ruling. And when the ruling does come it won't be in our favor so we'll have to wait longer for SCOTUS to take it up. We're a long way away from anything here. Those are my thoughts.I agree. Funny how the Supreme Court made this happen.
After listening to what scotus said to the second circuit I think scotus is watching this closely and is pissed they are fucking with us. If what scotus said is true we will have relief sooner than we think, I think??You aint seen nothing yet. They will only hear these cases in 2 months. They they could do a number of things. Probably a case concerning clown confetti copyright infringements.
With said confettiand what bathroom you are allowed to use ..
At this point GOA, FPC, etc., should be returning to the S.C. and stating that the 2nd has decided NOT to rule on this quickly. After listening to what scotus said to the second circuit I think scotus is watching this closely and is pissed they are fucking with us. I couldn't agree more brother.....At this point GOA, FPC, etc., should be returning to the S.C. and stating that the 2nd has decided NOT to rule on this quickly.
9 weeks...63 days...this is unacceptable when ONE DAY of having a right infringed is too much.
NYS, as well as each and every politicians that voted for this out of their own pockets, should have to pay a hefty fine for EVERY DAY our rights are infringed. These fines should be payable to the people of New York State.
I also couldn’t agree more especially when NYS a did it in direct defiance to Bruen and the SC ruling. At this point GOA, FPC, etc., should be returning to the S.C. and stating that the 2nd has decided NOT to rule on this quickly.

It burns my ass that the only ppl getting screwed by these blatantly unconstitutional laws is US...the law abiding gun owners....I also couldn’t agree more especially when NYS a did it in direct defiance to Bruen and the SC ruling.
I think they are slow walking it as much as they think they can get away with it . If 3/20 is the hearing date, I wouldn’t expect the opinion/decision until late summer.
