I doubt there is any FFL that can comply with all the regulations to operate their business. As an example, they must have a security camera showing the door from the inside and outside 24 hours a day and recordings kept for 2 years. After contacting their security people, a friend of mine told...
When you buy the gun one person does NICS check and gets the needed receipt then 2,3 or whatever people go to the county clerk and co-register it. One background check for the actual buyer. County clerk handles the rest.
When the NICS check is done online or on the phone the serial number is...
No, the dealer obeyed the law and wasn't going to do anything to jeopardize his business. By the way, even if you pass a NICS check, the dealer is not obligated to sell it to you if he suspects something is not right. That is left up to any dealers discretion.
It is much more of a hassle than you described. It don't really matter if its one day or a year FFL has to accept delivery, unpack it, log it in their book and then notify buyer that it is ready for pickup. some show up before it is logged in because tracking told them it was delivered and they...
MY response was one regarding yours that said it was lost in boating accident or just fell overboard. How can there be a buyer if your excuse is the gun was lost out on the lake?
Every state has their own laws for accepting out of state transfers. It is best to check with the party directly who will be accepting the transfer. NY requires every handgun to be on someones pistol permit or in the possession of an FFL. I suppose if you are in possession of a handgun not on...
The clerk would in all likelihood have you go to some law enforcement and file a lost or stolen form and get paperwork stating you did so. Ever lose a license plate in NY? The DMV won't replace it without you going to LE and reporting it lost or stolen. I'm pretty sure they won't make it easy...
Chicken Shoot, You kept telling me how wrong I am and then had Kristy respond in another post. It's been some time now and Kristy said she was going to check with the ATF people she works closely with. I'm wondering what she found out. If I'm wrong I will admit it and I would expect you to do...
Been pretty quiet here from those that blasted me for doing things illegal, according to them, and was just wondering what those who criticized me have come up with after their research. I'd be interested in what you all came up with and I'm particularly interested in why there is a...
Yea I guess if you want to find a way to nit pick a way to call or make it abuse of the system then I guess YOU could call it that. Yes in our market , that covers all of WNY, most are back in days and some are back the same day. Now as far as waiting 6 weeks, don't you think those people would...
No I am not *expecting* to have to do a second check but if the first is delayed And Cuomo's 30 day wait comes into play it is probably going to be necessary. If you wait to run the check until the day it's going to be picked up it could still be delayed with no definitive answer for 30 days...
Since Cuomo made his 30 day wait law, many have necessitated a second check and with the covid many have needed to redo a 4473 as the first expired. Explanation: according to law we had to run 2nd check because of 30 day wait, covid delays, and some people were just too lazy or didn't know the...
Your FFL does the check and if you get delayed or denied it becomes their problem. Not monetary because you paid for it but if just delayed and get proceed , no problem. If delay goes to "open" or denied it is a problem for you and the FFL to work out. NICS checks MUST be done in person.
Well this whole thread kinda blew up with Chicken Shoot and then he had his wife jump in. So where do we stand Chicken Shoot? I'm looking forward to you and your wifes opinion, or fact, after she talked to her ATF contact. Not being a pain in the ass but inquiring minds would like to know.
Are you sure you have to purchase before they will approve your permit? Or is it you must have a gun to put on your permit when *actually* picking it up? I have seen numerous people with acceptance letters from their county telling them they are approved and the FFL uses that when selling the...
I believe he said he wouldn't give a receipt without the background check. Why would an FFL sell a gun and have to store it for God knows how long not knowing if ever a person will actually apply for a permit? If a person has an acceptance letter for their permit then that's a different story.
Yea, a hypothetical way of making some one elses life harder for your own benefit. It would make for a confusing transaction and maybe in the end be less paper work but a major pain in the ass you gave the FFL. You might think they are making tons of money but in fact they don't have have the...
Yep you are right as far as Livingston County goes but you still can't pick up the gun without a coupon and a NICS check. If you are never going to take possession as you are using it for an investment you are screwing the FFL over because they still have time, paperwork and have to store it for...
Kristy, where does it say or where is this law that says you can't run the check before gun is to be picked up and why is there a recertification line on the 4473? How would you handle this situation: Person buys gun and you give this person a receipt. They now go and put it on their permit and...
The AG of NY is the chief law enforcer of this state and yes I contacted her for a clarification of the law. In your other response you said you didn't want to come off as a smartass well Wow! If I follow your advice how well will it stand up in court when I tell them Chicken Shoot from the NYGF...
If you look on the 4473 you will see there is a place the buyer has to sign when it is being picked up on a different day then they did the background check. That signature states that nothing changed since it was first processed. Why do you think that space is provided on the 4473? The gun...
Yes I know it is only good for 30 days and yes another check would have to be done if it wasn't picked up within the 30 days. I was asking why and where it says a FFL couldn't run the check before you came to pick up the gun. Why would they be in trouble with the ATF or any state or federal...
Cortland must be one of the few counties where you can pre buy coupons right? Coupon then background check then walk out the door with your gun that day. Your responsibility to put on permit within 10 days right?
Can you tell me where you got this legal definition from regarding the second check and the 3 day wait? I have contacted the head Trooper in Albany and the best answer he could give me on whether that's how it works is maybe maybe not. I have also contacted the NY Attorney General for an...
Then please tell me what happens if said person has the gun on their permit and then goes to the FFL and do a NICS check and it comes back denied? Can you tell or show me where the FFL can't run a check until the firearm in question is already on someones permit? Yes it must be on their permit...
The NICS system does not give a delay response when the system is down. Why? because the system is down and no information can be entered to get any response. If the system is down the FFL has to wait for it to come back up before they can run the 4473. Many are under the misconception that the...
That is true. You go and purchase the gun, do a background check and then FFL gives you a receipt to take and put it on your permit. In no case have I ever heard of a FFL giving a receipt without doing a background check first. In NY an FFL needs to see your permit or the letter saying you have...
Yes there is a time requirement. The NICS check is good for 30 days and must be resigned when you pick the gun up if it is a different day than when the check was done. When resigning you are swearing nothing changed from when the original check was done. If you wait more than the NICS check is...
So you are saying that some counties will put a gun on your permit then you go to pick it up and may get a denied response from NICS? I don't think that is true as I have worked gun shops and would never give a a receipt without a proceed response from NICS. Once the gun shop takes possession...
This is not just on handguns, it's on all firearms transactions. I brought this up a long time ago but most reacted with a I don't have a problem attitude. I contacted the AG saying it was unconstitutional because the federal check was only good for 30 days and after 5 days the NICS system...
For the most part NY, PA, VA and many of the western states are mostly 2A friendly. The difference is this state and most others are increasingly being overrun by the urban vote. As with NYC controlling all of NY, the same is happening to many other states now. Even Texas is becoming a lot more...
I had a discussion about this years ago when he said Virginia is the place to go. Look at Virginia today. You either fight now for a future generation or only care about yourself in the short term. This anti 2A will spread like a cancer. Either it's important to stay and fight for or YOU don't...
"We" throw money at a variety of groups and expect them to take care of problems. How many here make it a habit to pick up the phone, write a letter or even send an email ourselves? "We" have to get off our butts and do the bitching to those who make the rules instead of spending all our time...
Most Local Gun Shops don't sell on the internet. Why? because you need staff to do the paperwork and do shipping. A small LGS are not in the position to staff full time people and in fact have a hard time keeping their shelves stocked. Cuomo's shutting down of the small LGS was done in the hope...
200%? Where to you get that number from? Have you been to some of the cheap internet ammo places lately. Ammo prices are crazy high at the moment so the LGS has to pay higher prices too and still has to make a profit to pay the bills. Just for some peoples information, ammo and guns are not...
Exactly, after about a week the NICS system changes from a delay to open. Meaning you are most likely not going to get a definitive answer and now enter a "catch 22" situation. Our illustrious governor came up with this 30 day wait because he knew it would cause the law abiding gun owner...
Just a fact about Buds. Buds sells at low prices because they buy from the same wholesalers a small gun shop get theirs only at a reduced price. They basically drop ship to a local shop and have no federal or state paperwork to do. Then when a person picks it up at a local shop many piss and...
You can't find a basic 870 why? Because king andrew deemed Remington non essential. Same thing happened to all the manufacturers in this country. What guns and ammo were out there at that time is all that's available now. Then add in people getting an extra $600 to sit on their ass and you get a...
Check out K&K Guns in Varysburg, they probably have the largest selection of powders and reloading supplies in WNY. Check their website and facebook page.
